Who knows how to get beyond Ebay customer services?

And actually speak to someone who cares about the running of the site and the interests of the users of the site?

I had a problem with a seller breaching my consumer rights, harassing me, and breaching policy of advertising on Ebay and encouraging users to buy away from Ebay, where it would be the buyer vs the seller when it goes wrong.

My posts on Ebay have been removed and warned by Ebay not to ask for advice on having a seller stopped from breaching policy or why Ebay do not take action.

Trading standards not impressed with seller.

I am not impressed with Ebay not stopping a seller doing what he wants.

My refund will come from the courier, seller said didn't recieve package from me for instigating refund. Convenient I must say.

How about taking a deep breath and starting by explaining the problem?
Presumably you bought an item from a seller who had a listing on Ebay? You may then have bought the item from the seller but not via Ebay. Is that the case?
Having returned the item the seller has said he never received it and you are now claiming from a courier? Did you send tracked via courier? If you are claiming from the courier, the item was presumably not signed for? What value was the item?

I've no idea how hard done to you are from your post, it may well be very, it may not.

Select contact ebay and phone them, Dont post on the message boards.

And DO NOT use the online live help. Online brainless and hopeless more like.

If you sent the otem back tracked then a simple case will go in your favour and you will get a refund.

Op has already started a thread on the consumer rights board, can I suggest we use that one to save covering the same ground .

Incidentally, worth noting the issue appears to be a result of a deal that was undertaken outside of ebay, NOT on eBay.

I do not really see how this is Ebay's problem. Why should they care? They tell people not to buy outside of Ebay as you will not be covered if it goes wrong. If you do then you are on your own.

Its a bit like going to Tesco to buy a CD. Someone is selling it outside for half the price. You buy it and find it doesn't work. You then go in to Tesco to complain.

You are missing the major point here entirely.

I wouldn't have known about the seller, nor conducted a transaction, if he hadn't been allowed to advertise freely, and in contradiction of policy on ebay. Better?

I didn't go to a hawker on the internet, ebay are letting him conduct a bit of naughtyness, I wanted to know if ebay are in any way responsible for not policing their site even when people have reported a seller more than once.

eBay cannot protect people against themselves , this is not a nanny state nor should it be. They have no way of knowing the truth of what has happened as it is nothing to do with them, you went against eBay advice and dealt outside eBay therefore removing yourself from their protection.

Imagine the havoc that could be done by a disgruntled competitor reporting other sellers for all sorts of things that happened outside of eBay.

As I have said on the other thread, this is not an eBay issue, you must look to your payment provider for protection

Thanks for the advice about payment protection, bank had previously said they couldn't help, we'll see.

Point I have attempted to get across and doesn't seem to catch is:

ebay has accepted a seller has breached serious matters of policy -

ebay has stated they will address the issue and have action taken against the seller to protect others. Namely remove a business name from 1000 listings and remove from a shop banner encouraging users away, and to warn the seller not to message buyers not to use ebay.

ebay has not took action for a month and a half - still waiting to see enforcement - I wouldn't hold my breath though.

If ebay do carry out the enforcement action they have stated, it is not for my benefit - but for other buyers - that was my point to protect people falling into same trap as me.

So if you buy a TV from a "bloke in a pub" and it turns out to be stolen you immediately complain to the pub for letting the bloke in?

Sounds like you were duped and are trying to find someone else to blame for your own mistake.

Ebay have rules in place to protect buyer , if a buyer chooses to ignore those that not ebays fault.

Ebay is only a selling venue, its a bit like going to a large carboot and being scammed by a carbooter, its not the venues fault but the seller ..

I`m not sure what you mean by this

Are you saying this is what ebay have told you they are going to do?

Because i always thought any action taken against a seller or buyer was between them and that ebay never disclosed to the complainant what action was going to be taken. They merely say action will be taken.
