Really need help with capital one

I will try to keep this as short as possible but i would really appreciate any advice you can offer.

I had a capital one credit card which i payed off and canceled in 2004.

1 month ago i recieved a letter followed by aletter telling me i owed them money (about £60 i think). I spoke to them on the phone basically told them i owed them nothing as i had paid the card off and cut it up and was assured by them it was cancelled back in 2004.

They told me it hadnt been but they would clear the charges and the card would now be cancelled. Well they should have done it 3 years ago but ok its not cost me anything its all good.

Two weeks ago i had another phone call again telling me i owed them money (this time £142). As you can imagine i was a bit confused as i had been assured twice the card had been cleared and cancelled. This time i argued with them for ten minutes the guy put me on hold several times to speak to his supervisor and at the end of the conversation told me.

A. I didnt owe capital one any money
B. That it was now sent to the correct department to cancel the account.
C. That i would recieve a letter telling me the account had been cancelled.

I thought finally this is sorted.

A couple of days later i was looking into a loan to consolidate my finances ( getting a loan with a lower apr to pay off cc and another loan hence saving me money). I was rejected for the loan and thought that was a bit odd as apart from the rare late payment to barclaycard me credit should have been pretty good.

I got my credit report online from equifax and was amazed to see yellow and red marks all over my capital one account since 2004 ( yellow - warning red-danger i presume). All basically saying that my payments were late etc etc. My credit aggreeement score from equifax reads as danger (as in dont give him credit) as you can imagine this infuriated me.

My next plan of action was to get in touch with capital one by later and tell them i wanted all these after 2004 off my record as they should have closed the account back then. But before i can get to writing the letter this morning i recieve a statement from capital one saying my new balance was £57. The statement is dated the 9th of this month which is about a week after i called them the last time.

Anyway i am sorry for the length but i really need help. My credit score has taken a beating, this is really getting me down, i cant consolodate my debts ( wanted to do this before baby was born in 3 weeks). I am repeatedly getting phone calls and letters when the account is suppose to be closed i am at my wits end here.:cry:

    I would suggest that you write to capital one and state what you have stated here (with the relevant account number) and ask them to look into it, confirm they have closed the account, confirm they have cancelled all charges, and confirm they have got your credit records updated and the incorrect entries removed or corrected or however they do this?

    If you write to them and they resolve it that is fine...

    If they write to you and you are not satisfied with the outcome then go to the ombudsman.

    I would also go direct the company that has rejected you for the loan (if you still want it) tell them you are in dispute with capital one and give them the details and ask them to reconsider their decision. If they have a good system they should be able to review you account without reference to capital one and if the rest of your credit history is fine then maybe they will reconsider?

    You could also try calling Capital One on 0800 9525102

    Its the number I used earlier this week after they blocked my card and charged me a late payment fee because their system didn't take the direct debit from my account that they had been taking every month for 5 years!

    I didn't have much luck on their usual 0800 number as the staff in India don't seem to have been given much power to do things but this number seems to go through to the UK (I think its the Executive Office or the complaints dept)

    If not, then write to them as previously suggested.

    I have had similar dealings with Capital one heres what you do...


    1) Contact Experian who will look into this for you, what you need to say is that you have tried to sort it out with Capital one, but with no luck, and you have tried several times. They will put a note on your credit file which states that you dispute the information provided by them, so that anyone else who searches your file can see this.

    2) Speak to the Ombudsman set up a file with them and get a reference number. They might tell you that you need to wait 8 weeks after writing to them before they can investigate. This is true, however you can open a file up with them and get a reference number to use when you write to Capital One, this will give you more 'clout.'

    3) Write officially to Capital One you must do this, do not bother ringing them and telling them, it must be in writing and it must be sent by recorded delivery- keep the reciept slip.

    4) Keep records when you ring them keep a record of what time, number, contact name, department, extension number and what was said. It might sound over the top, but believe me it really gives you the upper hand when complaining. I use this method with everything important, and as an example it has helped me to reclaim over £1,000 in charges. I suggest using microsoft excel. If you need a template to use, drop me your e-mail address and I will send you one

    Do not worry if what you has said is true then you are completely 100% in the right and Capital One have alot to answer for. You can also claim back expenses (this is not guaranteed but worth a go) for any costs you have incurred in getting your credit file, not getting the loan, postal costs e.t.c.

    should be all English speaking, ring within office hours and ask for the customer services manager.

    The name I have for reference is Sven Largerberg (for your letter to them)

    with regards to the claim you can also contact the information commisioner (who regulates the credit files) they might be able to help you further. The number you can get from experian...you can get that one yourself im off out!!!!lol
