do you think this needs a better wording or it is a perfect thing?

Sunday 15th June 2014 Car Incident Settle Agreement
On Tuesday 10th June 2014 at roughly 6.15pm on Radford Bank opposite Freedom Caravans London GB10 0GB, Mr Smith driving a Citroen Xsara (reg AA55 AAA) whilst having to brake for traffic in front was impacted in the rear of the vehicle by Mr Wizard driving a Audi A6 (reg BB55 BBB). Mr Wizard admitted liability stating that the sun was low and obstructing his view.
I, Mr Smith of 10 Super Close, London, GB15 1GB can confirm that following receipt of £449.07 from Mr Wizard that no car motor insurance claim will be made. Whilst information has been provided to my insurer (Aviva) this has specifically done on an “information only” basis and this can be confirmed by my insurer. Should I be approached by with Aviva or Mr Wizard’s insurer (Admiral) regarding the matter it shall be explained that the issue has been completed without the need to go through the insurers and make a claim.
All damages and physical injury claims related to the accident that occurred on Tuesday 10th June 2014 are paid in full with this £449.07 amount and I forever release Mr Wizard from any future claims. Shall a claim arise against Mr Wizard for any reason I, Mr Smith will be obliged to reimburse the full amount of the payment back to Mr Wizard.

I, Mr Wizard of 22 Easy Road, London, GB13 7GB can confirm that following a transfer of £449.07 to Mr Smith that the matter is now resolved and completed and no claims will be made be either party. Whilst information has been provided to my insurer (Admiral) this has specifically done on an “information only” basis and this can be confirmed by my insurer. Should I be approached by Admiral or Mr Smith’s insurer (Aviva) regarding the matter it shall be explained that the issue has been completed without the need to go through the insurers and make a claim.

Very nice but not a guarantee that either party wont contact their insurer in the near or not so near future.
What happens if you settle and in a few months an MOT or service finds a severe fault caused by the accident but probably not visible at the time of inspection? Are you happy not to make a claim and have to fork out repairs from your own pocket?Censorship Reigns Supreme in Troll City...0 -
It would be an unenforceable document, though may discourage someone.0

Also it has been recorded on the phone call.
