Technically he can. Legally speaking the garage cannot withhold the car from the owner regardless of what work they've carried out.0 -

If they order for the parts at their expense on the basis they would do the work as agree'd and they had started to strip and OP break that contract, then the garage can legally hold the car in lieu of the work that has been started and parts that have been ordered.
The second option is they let the car go and then take OP to court for their outlay of costs and surcharges and restocking fee's incurred.
Third option would be to hold car in lieu charge storage costs until payments in full if no payment in full by a certain time period they could sell the car! and hand back the cash that was left after labor and charges were deducted.0 -
Any costs incurred on the first replacement SHOULD be covered by the supplier to the garage......“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

They can hold on to the car until paid, they have a lien over it.
Pay for the gearbox repair, even write on both copies of the invoice that you are paying under protest, and do so with your credit card. Take the car to a reputable, recommended, local repairer and explain the tale so far and get them to assess it to see what it needs and what it will cost. Unfortunately this forum doesn't have a protocol of detailing make, model, engine size and age of cars with queries (is it a green one?) so impossible to guess if your getting a good diagnosis or even if you are throwing good money after bad.
If the original garage were taking the P, exercise your cover under section 75.
Incidentally, having run my own businesses for many years, I certainly wouldn't be stuck at home, not earning, because my car of choice was laid up.0 -
Also £400 is VERY cheap.
One wonders if they tried to fix it themselves.......“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”
