Small Claims Court advice

Hi all,


My wife booked a cheap short break weekend with Park Holidays in May. When we arrived on the site and was given our accommodation is was sub standard to say the least. It was only a caravan but every wall was marked, the carpet was lifting and missing in places, the toilet hadn't been cleaned since the last guests as there were still parts of them there if you get my meaning. There was fat all over the cooker splash panel, penicillin growing in an old glass found under a bed. Dirt and dust everywhere. Windows didn't close properly, snails under beds and general filth everywhere you looked. The final straw was the blood on the quilts left for us to use. It wasn't a small amount either!
We complained to the manager who couldn't move us as he was fully booked. We went to show the head cleaner the issues and the manager sneaked off home for the weekend.
We went back to speak with the duty manager who refused to come out of the kitchen and speak with us. We were not kicking off in anyway at all, not even raised voices.
The child serving behind the bar realised it was a problem with accommodation and said "haha, yer we get that a lot"


Head sales bloke was the only person we could talk to who couldn't refund us there and then as it had to go through head office. Had to leave as I wouldn't allow my dog to sleep in that place let alone my 4yr old child. nearly 300 miles later the next day we had arrived at a different place and enjoyed a weekend.


Emailed head office when we got back and they sent it to the sneaky manager who went home. He promised a refund but never came through. Complained to head office again and they sent it back to him and it never got refunded. Nearly a month later I wasn't getting anywhere with head office or the Park directly I emailed a complaint and claim for
full refund
evening meal for 3 which we wouldn't have had to buy out
fuel for 300 mile journey home and back to another park
price difference between the bookings
£50 for the time spent having to email and call over the last month.
Failure to act in 14 days would mean me raising a claim in a small claims court.


I then get an admin assistant email me for my card details as she has been told to give a refund only. A refund for the cost of the original holiday only was issued 18 days after my email.


The question now is do I continue and make a claim at a small claims court for everything listed above?
They have issued a refund for the cost of the holiday but the extra expenses are nearly another £200 and that's without the time I've had to spend trying to sort this out. Further to this I feel that the way we were dealt with was disgusting.


I feel that I shouldn't just accept this and should continue with a small claims application but would it get anywhere??


Interested to hear people thoughts on this...

    Did they offer to clean the caravan when you initially complained?

    Why did you have to return home if you were going to holiday in the same area anyway? I think you may find you can't claim for "your time".

    It is easy to do it online and doesn't cost much, but be aware that if you lose you'll have to pay their costs too. You have to prove to the court your loss was caused by these hillbillies.
  • They came to assess the condition and then offered to call the cleaner back but to be honest it was I such a condition it would have needed to have been steam cleaned.
    We had to travel home and then back to place around 50miles north of where we had been as by the time the condition of the caravan had been discovered and the cleaning assessment had been done the manager had sneaked off home. There was nowhere else on site to stay and we couldn't check into another park nearby at that time of night.
    We called all the parks local but couldn't get in till the next day.


    Just debating if this is worth continuing.. I think it is but not sure if it will go anywhere as I have no experience with small claims courts.
