The Shelter website has a relationship breakdown section which will outline your rights and options (including perhaps the chance to secure an occupation order which will give you the right to live in the property until your youngest turns 18), plus it has a section for homeowners at risk of arrears and repossession. Call them for advice.

As a lone parent with a low/non-profit business (and assuming you have capital below 6k like savings), you should be getting around £225 per week in child benefit, working tax credit, child tax credit, plus hardly any council tax to pay and you may have entitlement to housing benefit on the rental part of your shared ownership property.

As a lone parent, you are only required to work 16 hours per week to qualify for working tax credits. Have you considered winding down your non-profit making business and getting regular part time employment? Even a national minimum wage job will pay you £100 a week for 16 hours so this will increase your household income.

Check out the benefit calculator at the Turn2us online website.

According to the CMS calculator, he should be paying at least £107 a week to you (assuming he nets around £700 a week after pension contributions). Have a play around with the calculator.

So can you cope with the expenses if you get full CMS from him, plus perhaps get a regular part time job as your income might be closer to £400 a week or is the mortgage element simply too high to cope with?

I assume the part time job could boost your income by at least £50 a week, perhaps more, after tax/benefit reductions but you can model this on the Turn2us online benefit calculator to check it out.

Post your debt issues on the Debt Free wanabee forum in case your IVA needs to be revisited. The Direct Gov website also has good info, including links to free expert debt charities.

Download the MSE budget planner to get a handle on your full income and expenses.
