Husband left after having affair
Two kids
Mortagage
IVA (now failed)
Bills etc
Pays a little below CSA for kids
he has left me with a mortgage and a shared ownership house.
neg equity
bad credit score (so cant rent or get better mortgage better deal)
Solicitor talking of spousal maintenance but not sure??
Any advice?

Only, don't panic - you'll get more/better responses later in the day. You can rent as your credit score is a number some made up, my credits crore is 10756! Just something quick and positive.
Spousal maintenance : how long were u married? It's uncommon these days. - do u work?
U'll have to sell the house and both pay the overage I'd say. But your solicitor may help with this.

This free site includes forums dedicated to the whole subject including support forums dealing with the emotional fall-out. I have used it myself and found the advice and support invaluable. There are a lot of friendly and helpful people on there.

Wow your post scares me as Ive been told that I cant be forced to sell due to neg equity?!?! Plus it would make me and kids homeless?!?! And as im on the insolvency register due to IVA cred score is shot so I cant rent through an agent?!! I cant eve get a mobile phone contract lol. Married 6 years, been separated 3 now. Taking too long with solicitor and yes, I have a small business which ran at a loss last year so basically live off tax creds0 -

Sorry i didnt mean you HAVE to sell, I meant if you cant afford the mortgage, you'll clearly need to sell and rent cheaper.
Who told you, you cant rent through an agent (just so we're clear, the agent, any agent you will ever meet, is no more qualified than me or you officially, and definitely not more qualified than alot of posters on the housing boards) anyway as long as your honest its the Landlords choice, always the Landlords choice as that who you rent from, whether they rent to you or not. & you'll be a priority for council housing if you get evicted due to mortgage.
A mobile phone contract is a credit agreement, a tenancy is not.
So you were together 3 years in total, or 6 years, then 3 more seperated. Either way really no you wont get spusal maintenance.
You havent been deprived of a career through childcare (officially) and you have a business. Chances are everything will be split 50/50. You'll get child maintance which may help you pay off the mortgage, but depends what he earns0 -
Local agents want 6 months rent upfront for people who fail the credit check. I CANT AFFORD THIS

For 2 kids you should be receiving 20% of his salary.
Have you spoken to shelter?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

You'll get 20% of his salary for child maintenance as mentioned by the previous poster. You'll likely get to keep the house too seeing as it wouldn't be a bonus to either of you to sell. You'll also receive extra benefits as a single parent.
What else are you actually expecting? Spousal maintenance certainly won't be a possibility in this case.0
