Thats the sought of reply I was after, non patronising. The other car did stop for about 5 seconds. The footage is from the pub on the junction of which I am told I cannot see and therefore pass on to the police. If my son is going to get partial blame due to evidence given thats fair enough I don't see the point in challenging. To the people talking about cyclists there quite a bit narrower than a car leaving and plenty of room to go round.
Dacouch all evidence is from cctv footage so doesn't matter what was said.

The insurance company have a copy of it and have refused to let me see it. When we asked the Pub landlord for it to be submitted they said no and then sent it to the insurance company as the other persons evidence. I understand that it would have been great if my son had seen the other driver but he didn't. It may have been because my car has dark tinted rear windows (as standard) but according to the senior claims handler its a 50/50 they don't seem concerned regarding the legality of the other persons driving. I was told by the insurance advisor that it wasn't worth going to court as the judge would only give 50/50 and thats why I have asked for advice.

I think without having seen the footage, you'll have to go by your insurers view, I'm afraid.

Dacouch The indicator was not the reason for the 50/50 as stated in my first post.
