I suspect rs65 is right.
On the other hand as DunstonH notes, if there is evidence it would probably be fairly easy. This is because the salesperson will be acting for the insurer rather than the consumer and FOS would deem it to be what is known as a colateral contract (and thus binding - so the claim must be paid).
By contrast, an independent adviser (such as DunstonH) is the agent of the consumer, so the redress would normally be a repayment of the premiums plus interest.
