ArrowXL (Yodel) delivered a washing machine and removed an old one back in May. They damaged flooring and doors/frames. To cut a long story short, despite many emails and photographic evidence, they are saying they will pay for flooring but NOT doors/frames. They also state that they will only send cheque direct to company of their choice from 2 quotes I send.
a) How can I get them to pay for the door damage too? They refuse to tell me why they think this wasn't done by the drivers but that they DID damage the floor...
b) Can I insist that the payment comes to me directly rather than any other company? I've sent quotes from B and Q etc for flooring and showed what the labour charges will be (easy to find online) and they still won't pay.
This is rather different as clearly I don't have a policy with them (the order was through Littlewoods catalogue who have completely washed their hands of this as it was Arrow Xl who did the damage). I want to be able to pay myself by credit card so that I have cover (and also will use not the cheapest company as I want a good job done and will upgrade flooring/doors at this time - not that I'm asking them to pay for this). I have hit a brick wall with Dean Dowler at Arrow XL....

Your contract is with the vendor, if the vendors supplier causes damage the vendor is still responsible for dealing with it. If they dont want to then they should hire better suppliers that dont damage their customers goods.
As you are this far down the line with the supplier you may as well stick with them. Without knowing why they dispute liability for the door its hard to negotiate over it but as this is a small track case there isnt much that can be done about it.
I'd send a letter before action stating you want a cheque for £X where £X is made up of (1) the flooring at £Y and (2) the door at £Z and if you do not receive the cheque within 21 days that you will issue county court proceedings against them to recover your losses.
Enclose in the letter two quotes for repairing each of the items where Y and Z is the lower of the two quotes in both cases.0 -

I have done all of this: Sent quotes from various websites, written to say what I want, asked for clarification on why they won't pay for door damage, but I can't get any response from them.
I've asked for the case to be escalated (they have, after all, admitted liability for damage to floors), but again nothing. I really don't want to have to pay out in small claims court to get my money (for something they've done!), but I'm at a loss as to where I stand. I apparently can't claim the court costs back.0 -
You can. You just add all your costs onto the amount claimed. If you win, you get all your damages and costs paid.0

The LBA should state that the court fees will be added to the claim but that will happen automatically anyway without you needing to highlight it (assuming you win of cause)0
