Scottish car with private ticket in England

Hi, I'm looking for some advise. I have read the FAQs and other threads but cannot find the answer to my problem.

While on holiday in cornwall I received a late parking charge notice on my windscreen. I do not believe that this charge is correct and obviously do not want to fork out the money if it can be avoided.

All advise I find about private parking charges in Scotland suggest that they can be ignored and this is fairly common knowledge in Scotland that they're not worth the paper they are written on. However, if the car is registered in Scotland and the parking charge is issued in England do the same rules apply?

I have watched the watchdog clip and understand that this is still valid advise and followed the flow chart that also states that the car needs to be registered in England before it's worth submitting an appeal.

Any help would be greatly appreciated.

    Well as long as it's not a lease/hire car then you don't have to do anything. The next thing you will hear is a letter next month. If you are so minded and would prefer to stamp on it rather than endure months of silly debt collector letters (leading to nothing, but annoying) you 'could' play a game with them and appeal with the template and add a point 'D':

    'You may have noticed I am in Scotland and the POFA 2012 doesn't apply to me so there is no keeper liability. But if you want to test that at POPLA then go ahead, make my day!'

    But don't send it in response to the windscreen ticket and you don't have to reply at all, let them send letters if you aren't bothered. Which PPC?

  • Thanks very much for your reply. I'm a newbie to this forum and appreciate your help.

    The Company were called Armtrac Security. I'm quite happy to ingnore the letters that will surly arrive through my front door and now need to convince my father in-law to do the same. He received a ticket at the exact same time.

    Sorry if I've missed an obvious link, but where can I find details of the position in Scotland regarding Parking Eye "fines" and what to do about them? I ignored one a few years ago and had no follow-up but I believe it may now be better to respond (but still refuse to pay).

    Any help appreciated, thanks.

    You won't - because they are not fines.

    For all other forms of speculative invoice, you need to read the Newbies Sticky - which is the very first thread on the Forum and linked in Coupon Mad's sig above. It contains the current info for Scotland and NI, which is actually unchanged - So you can still ignore.

    Lastly, please start your own thread if you need any further help. Do not pitch-up on someone else's.

    Not quite right, surely. POFA does apply, as the parking event was in England. The difficulty comes in chasing it through the courts, as there are problems in bringing a case against a Scottish resident in the English courts.

    A Scottish keeper isn't liable though. But I did give the OP an alternative and could squash his and the father in law's one at POPLA using the usual templates. No reason why not.
