Please can you advise if you are contractually obliged to live in the property. If so, please supply a copy of your contract that states this.

What can I use as evidence for this?

Perhaps a copy of your Assignment Order, a copy of your payslip showing deduction for FQ and a copy of the JSP outlining who can and cant have a FQ would suffice. There will also be a local order outlining how far from their place of work personnel can live, and if not, JSP 752 Home-Duty may work!

You are missing the important word here 'need'. There is absolutely nowhere where it is laid down that someone has to live in a married quarter. It is purely personal choice.

I think JSP 752, states 50 miles or 90 minutes travelling time, whichever is greater with regard to how far you can travel daily, without authorisation from the CO.

But if someone does live further than that, that does not mean the NEED to live in MQ's. The can just easily stay in SLA and travel home at weekends.

Its all about interpretation. Some HR staff would say that if you are posted hundreds of miles from your family home, then there is a NEED to house the family within 50 miles. Others would shrug their shoulders.

Maybe the different councils interpret things in a similar way....

Then I would say that interpretation is wrong. I am not arguing against their entitlement to a SFA, as they would be entitled, but that is far different from having a service NEED to be housed in a SFA.
