Windscreen PCN Illegable

Hi

My girlfriend drove my car last night and got a PCN on the windscreen, she only noticed it this morning and is not sure where it was from, the company is UK CPS Ltd. The details on the PCN are illegible as the details cannot be read, they are far too faint. I would appreciate any advice as to what my next steps should be?

    I have read the stickies, but as unsure of if she did park illegaly as we dont know where she got the PCN, do not want to lose the chance to pay the reduced £100 instead of the £60, as £40 is a lot of money.

    as its UKCPS its a private parking ticket so there is no "illegally" here

    as I said , wait for the NTK and learn about this process and "game" and "rules" , stop panicing , calm down , then deal with it when the NTK arrives

    And you think £60 is OK?!? £60 is a lot of money, too, so it's a good job you won't be paying it. Just follow the process.


    It could be claimed that you have not been issued a Notice to Driver. If it's illegible, then it is a meaningless piece of waste paper. That will mean the Notice to Keeper will be too late for them to use POFA and keeper liability.


    UKCPS won't see it that way, and you'll need to use all the usual winning appeal points.

    When you do get the NtK one of the points you will challenge on is that they have failed to establish keeper liability because the (illegible) Notice to Driver did not comply with the requirements of POFA 2012 Schedule 4.

    Just how many ways can UKCPS find of shooting themselves in the foot? They're very good at it!

    if I send you an illegible invoice or place it on your car wanting £100 or pay £60 if you pay within 2 weeks would you just pay me ?

    or would you wonder what its for ? , if you are liable ? , what laws are you operating under ? , what gives you the right to issue the ticket ? , what gives you the right to charge such an extortionate fee ? (both £60 and £100 are extortionate)

    so wait for ntk, appeal it using the template letter once it arrives (with free proof of posting at the PO) and then we deal with it down the line if it goes to popla

    keep this illegible ticket, its an extra appeal point

    do not "wing it" - use the correct advice from here to win and pay nothing at all , meaning you have saved £60 to £100

    then tell the driver to be careful where they park and read any signs etc

    Thanks for all your advice, will do as you have all suggested following the advice from this forum, and have already told the driver to read signs that are there.

    Get a photo of the sign asap would be good, and a photo of the entrance showing a lack of signs which is often the case. UKCPS are gradually changing some signs in some car parks so get a pic now of how obscured they are at night if it was dark when she parked (take the pic in the same conditions without a flash!). You can use it for your appeal evidence for POPLA stage which the NEWBIES thread tells you how to win (100% record so no need to panic and pay).
