Parking Eye PCN @ Tesco

Hi all,
To start from the top, in 2012 I received a private parking notice. I did my homework (most of which was from MSE), and the general advice was to ignore it, which I did, and nothing ever happened to my knowledge.

I have recently started very occasionally parking in a Tesco carpark opposite my work, as I felt that it wouldnt be an issue as the tickets were not enforceable (I know, I know). I have probably had two letter from Parking Eye, who manage the carpark, for two seperate occasions and that was it.

I received another today and thought it might be a good idea to check i was still doing the right thing, and research has shown me that the guidance has now changed. I was looking for advice on what to do...although the other two letters were never followed up in light of this new advice I am now concerned.

The most recent letter concerns the 3rd of July 2014 and I am still within the 14 day initial period. I was hoping to stay under the radar and hoped that it went away however advice on here suggests that this may not be the best way forward.

Ironically my place of work has an agreement with the Tesco that some of the employees can park there if we give our name and car reg to a designated person at work..again I didnt do this as I didnt think it would be necessary; obviously I wont be making this mistake again in future.

I am now panicking about all the other times that I park where i like and am expecting an influx of letters to arrive through my door =/ I am also concerned as I need a spotless credit record for my job, so no claims being brought against me etc. Could anyone give me any advice as to how to proceed from here?

Thankyou :)

If you have done your research you would have read the Newbies thread. All the advice you need is in there.

You will have nothing on your credit record unless you end up in court & get a CCJ which you fail to pay!

As you are withi9n the period its easy to see these things off.
You could go in with a knowing appeal to see if parking eye see sense and cancel something like/ along the lines of I work at <PLACE> and I am aware that they have a car parking agreement with the Tesco in question. However I was unaware of the need to inform a designated person on that/those occasions.
As the parking charges you are demanding do not represent a genuine pre estimate of loss amongst other things POPLA are bound to rule in my favor I am giving you this opportunity to cancel this ( and any other) parking charge invoices without the need to use POPLA.

And if you need to register with someone to use the car park, do it.

So to confirm, if I was given a CCJ then paid it, that wouldnt show on my credit record? Or count as discharged or an actual CCJ? Im not 100% sure what counts on credit and what doesnt :/

Also, I did do my research, and still found it confusing as there was a lot of text to sift through...I find it is usually best to clarify if in doubt!

You only get a bad credit record if you fail to pay a CCJ within the time limit imposed. But his is not going to get anywhere near this far!

You need to go ahead and send the appeal in the newbie thread before you get worried about failing to pay CCJs which you are certain not to get. This forum has 100% success rate with forum assisted appeals to POPLA, the second stage appeal!

Ok i have just found a letter from parking eye as the letter before county court claim, which was dated from 07/05/2014 saying that if i didnt pay in 14 days i would be taken to court. I completely forgot about this letter and as I suffer from anxiety etc i have paid it. Does this mean that the 'debt' is now wiped even though the 14 days have passed?>

Oh dear, that is not the news we want. We never want people to pay these PPCs anything.

This has been a confusing thread. If the initial PCN was before OCT 2012, then the keeper, you was never liable. You could have kept on ignoring letters ad infinitum.

I thought you had received a new PCN, which was why I was encouraging you to appeal. My apologies, I misread original post.

Can you confirm you have only ever received one PCN, that it was PPC that sent you the LBCC and that you have now paid this. Or are you expecting other PCNs to be chased up too?

And yes if you have paid, you will NOT get a CCJ! The (not real) debt has been paid. You have never been to court, so nothing is on your credit record.

Should you ever get a PCN again, come back here and we will help you to appeal successfully. We could have helped you fight the LBCC too.

Yes if you paid the amount demanded on a LBCCC, before court proceedings then you have wiped it. There was never a debt but I can understand this is enough to send someone with anxiety problems into a real spin.

Did you mean from your first post that you have a new PCN from this month to appeal though? What was 'the most recent letter {that} concerns the 3rd of July 2014'? If it was a new PCN then send the template appeal from the NEWBIES thread online - simply copy & paste it into the appeal box on the PE website and wait for the sill long pages of rejection letter.

Is that what you meant - a new PCN now as well? It wasn't court papers about this older one was it?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I wasnt a 100% sure before, but now i have looked through various letters that i have received over the recent months:

1 from 12 March 2014 - received a warning notice on 22nd April - ignored. Then received a lbcc on 7th May which i ignored, then found today and paid - so obviously outside of the 14 day mark but i wasnt sure if that mattered as surely once theyve accepted the payment that is the end of it.

I was just a bit nervous about a potential ccj. The job i do would mean i would be unemployed if there was any serious negative credit history.

I've had another letter about a more recent breach today, from the 3rd of July - this is the one I am more than happy to fight!

If you pay before you go to court then it is gone.
The new one you need to appeal as per the newbies thread. Send off the template in post 1. And reasonably soon.
