MET windscreen ticket - lease car - advice please
barras
Hi there,
I've received a windscreen ticket from MET parking. I understand the normal advice is to wait for NTK. However the car is leased and i am not the registered keeper - the lease company is.
Last time we got a scammers ticket it was from CEL based on ANPR - and the lease company wrote us a letter stating that unless we appealed or paid etc they would have to pay the ticket and pass on the charge plus admin fees as there is different legislation for lease companies. We got it cancelled of course using advice here!!
So - i guess what is my course of action? I intend writing to the business i was visiting to see if they can get it cancelled - should i attempt any contact with MET or wait for the lease company to pass over my details and then do the standardish template letter?
thanks!!

all covered in the NEWBIES sticky thread with a section on leased cars, please read it , bearing in mind that you need to appeal as driver and get them to deal with you, not the RK0

Follow Redx' advice and read the newbie thread which explains all this. You need to appeal NOW!Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.0

I think you need to educate the lease company (and charge them a fee for your knowledge). There is no specific legislation for lease companies. There is no requirement or even scope in POFA for them to pay and pass on the charge. All they need to do is to name the "keeper" and that completely discharges their obligations. If they are incapable of reading and understanding the guidance from the BVRLA, then they don't deserve your business.Last time we got a scammers ticket it was from CEL based on ANPR - and the lease company wrote us a letter stating that unless we appealed or paid etc they would have to pay the ticket and pass on the charge plus admin fees as there is different legislation for lease companies.0 -
You need to appeal quickly as driver (use the normal template letter which already ID's you correctly as merely 'the keeper'). You ARE the KEEPER, just not the registered keeper.
As for the lease firm, here's something I wrote a whole back for a Fleet Manager to send to their Lease firm to iron out the issue properly:
''The Protection of Freedoms Act 2012 enables you to discharge your potential liability in one simple letter, passing on the driver's details to the company who has sent the notice. The BVRLA actually instructs its members to do this as good practice - it means you receive no further letters as the charge becomes the driver's issue. Private Parking firms cannot revert to you under POFA 2012, once you have given the name and address.
Our drivers are happy for you or us, to pass on their name & address details so that the private firm (who are not an Authority and cannot issue fines) have a tangible name and address to pursue. This also absolves yourselves/ourselves as the owner/keeper from any liability - surely this should have been your default policy for private parking tickets in England & Wales for two years, since the POFA 2012. Under that Act, as a lease firm you can just send the details of the hirer to the firm within 28 days and you would hear no more and more importantly, your firm would then have no liability.
We do not understand why this has been allowed to drag on so long; and why it has been down to our driver to research the law for you? It should not be your policy to do anything other than to pass on the driver's/hirer's name & address immediately by template letter. Indeed your current stance leaves you vulnerable and denies our drivers their own chance to appeal and ultimately to get these worthless invoices cancelled by POPLA or other independent appeal.
These are not real PCNs, not at all like real penalties/fines from a Council or the Police - and as a BVRLA member, your approach to them should be consistent and speedy, to ensure you are never pursued further by these notorious firms and so our drivers can handle the issue and appeal to POPLA, as is their right.'PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
