County Court Claim Form From CEL

SGF58
I seem to have skipped a number of steps compared to other posts and have received a county court claim form from CEL via the Salford CCMCC. Although I probably have not done everything I should have to avoid this (ie totally ignored them so far) I am convinced that I have a really good defence on several counts, and would be delighted to go to court and rub the bullies noses in it. However, I could do with some advice about my initial response and approach from a friendly forumite.

Please see post #5 in the NEWBIES sticky thread. Please also see bargepole's thread about CEL that is currently on the first page of this forum.

I go to all the trouble of writing this out: https://forums.moneysavingexpert.com/discussion/5016317
... and still we get new posters coming on and asking the same questions which have been answered 240,000,000 times before!

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. Apologies if I seem to be asking basic questions because I have not read the threads, but that is not the case - I was merely following advice on said threads not to give too much away in the public areas of the forum. I know exactly where I am in the process and am at the point where I need to construct a defence, so was hoping for some help with that. Clearly I will provide full details in 'private'0

If you also post on pepipoo.com forum, 'Gan' is picking up a lot of these and helping with a template defence:

HTH and if this is the Co-op they ARE still paying these off when customers shout loud enough.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks coupon-mad. There are a couple of unusual procedural things in my defence that I would like to discuss with someone who knows about these things, particularly whether I can use things if the case goes to court that I do not mention in my 'defence' notes now, given that at court they might be a 'knockout blow', but if I disclose them now, they are potentially easily resolved by CEL.
I have read the threads about the CO-OP paying fines and this really alarms me - I could take that option but surely the more times the CO-OP pays, the more CEL will be encouraged to issue court papers, knowing that the Co-Op will pay before the case gets to court. It will simply drain the Co-Op and fill the boots of CEL, as well as more people like me receiving the dreaded court papers - none of those things can be seen as good.0 -
We agree with that as well, none of it is good. I would post on pepipoo and see if Gan picks it up, then ask him the questions you think are specific to your own case. He's helped with DOZENS of these.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
