Hi all - first post.

My situation is this - I used to have a credit card which I have accumulated £2600 debt on.

In 2012 I found myself in a situation due to health reasons whereby I could not pay this debt off, I wrote to them and they stopped chasing me for the debt and froze all interest. I was threatened with a default but do not think it ever materialised (have checked my records and can't find a default letter).

Two years later and every month I get a 6 month late payment mark against my credit file every month. It is continual and relentless.

Even after 6 years this mark will never go away as it is regularly hitting my account each month.

Have Barclaycard been a little bit clever by not giving me a default?

Are they doing anything wrong?

What is my best course of action?

    They should be logging an arrangement to pay (if you are) or a default within 6 months of no payments.

    Complain, in writing, asking them to fix it.

    If they refuse, take to FOS.

    So once I have 6 months of late payments Barclaycard are required to issue me with a default?

    I have been issued with late payments for more than 2 years now. Will they back date the default?

    Or will I be defaulted this month and have a new 6 year timer on my credit file?

    If it hasn't defaulted are you not in a position now to pay it off? Then it won't stay with you for ever.
    I have enough money to last me the rest of my life,as long as I die next Tuesday.

    Are you receiving any letters in the post about the account?


    I'd say the best thing you could do is contact Barclaycard and ask them what has happened to your account. Maybe they just froze your account and forgot about it.
    I have enough money to last me the rest of my life,as long as I die next Tuesday.

    No I dont receive anything from them.

    If they had forgot about it then they would not be updating my credit file each month stating that there is a late payment.

    Is there not a standard procedure that they have broken by not defaulting me back in 2012 and by continually marking my credit file as late payment?

    It would still update if you pay it, don't pay it, frozen or defaulted.


    They usually default between 3 and 6 months of missed payments. Not sure if they are breaking any regulations by not defaulting you.
    I have enough money to last me the rest of my life,as long as I die next Tuesday.
