Cheshire Services CP Plus

Hi Guys


I have fallen foul of the 2 hr parking limit at Chester Services last month was actually on site for 2hr43min and have received letter from CP Plus saying there is a £90 fine reduced to £50 if paid with 14 days.
I am aware this is unenforceable according to most of the info I have read on line and I should just ignore, the problem I have is the car is actually on hire from enterprise and they themselves are charging £35 admin fee everytime they forward a letter fom CP onto me, so in a catch22 as if I ignore the fine I will soon be paying more to Enterprise in their fees?


Any advice gratefully received.

    1) its not a fine , its an invoice

    2) only a fool would ignore this in england or wales due to POFA 2012

    3) ignore hasnt been an option on here for over 18 months so no idea where this IGNORE idea is from ?

    4) please read the NEWBIES sticky thread at the top of this forum, especially the part on leased cars, and all of the first post there too

    #1 Check the contract T&Cs. This is NOT A FINE, it is a private invoice. Therefore their admin fee is an unenforceable penalty. (Search this forum for BVRLA).

    #2 Search this forum for MSA (motorway service area) - lots of similar threads already exist.

    It's not a catch 22 as we don't tell people to ignore them. It's not a fine either. Read the top thread and appeal as the driver (change the 'registered keeper' to 'driver' in the template appeal).

    Enterprise standard rental agreement:

    The crucial bit is this:

    You shall pay to us on demand:
    • All fines and court costs for parking, bus lane, congestion charge, traffic
    or other offences assessed against the Vehicle, us, you, any other
    authorised driver or any other driver you permitted to use the Vehicle
    until the Vehicle is returned unless cause by our own fault;
    • A reasonable administration fee for processing any fines or offences
    against the Vehicle, you or us during the rental period, unless caused
    through our own fault;


    A speculative invoice from CP Plus is not a fine, and you have committed no offence. Accordingly Enterprise has no right to charge you anything. You should write to them immediately pointing this out, demanding the return of any £35 admin fees they have already charged you, and expressly stating that they do not have your authority to make these charges against your card.

    You should also write to your card issuer stating that any charges made by Enterprise regarding this matter are unauthorised transactions as they are not covered by your contract with Enterprise, and you expect the card company to (i) reimburse you, just as it would be obliged to do with any unauthorised transaction and (ii) decline any future transactions in favour of Enterprise unless Enterprise can show your express authorisation for those transactions.
