Cash Converters say i have 7 days to return broken item

Hi

My local cash converters wont let me return a broken hard disk as I have been more than 7 days since i bought it.

I explained i was on holiday so was a week over that, and thought the 7 days was a change of mind limit.

They said this is their "policy". I have contacted trading standards online but have had no response after a week.

It wasnt expensive, but I dont know what to do,

    They are required to provide a remedy (repair, replace or refund) IF you are deemed to have "accepted" the goods. My opinion is that you have accepted them (in the legal sense) - the fact you were on holiday is not their fault.

    But that doesn't remove their legal duty under the Sale of Goods Act. You can request a specific remedy, but essentially it is their choice. But they must provide a remedy. (If you hadn't "accepted" the goods then you could demand a refund).

    As far as Cash Converter's policy goes - it is fine for them to set a time limit on returns for change of mind, but that policy doesn't do away with your statutory rights. You should make it clear to them that you are not returning the item due to change of mind but because it is faulty - it isn't their policy that applies but your rights under the Sale of Goods Act. You are entitled to a refund, repair or replacement - if you reject goods as faulty quite quickly (the law says within a 'reasonable time) you can insist upon a refund but if it is now two weeks since you purchased this item it is likely that you will have to accept a repair or replacement if that is what they offer.
    Common sense?...There's nothing common about sense!

    they arent offering me a repair or replacement, but they say its CC policy. something should be done about a high street name doing this.

    Then you need to do 'something'.

    Start by explaining to them more forcefully that which Browneyedbazzi has already told you.

    If they still won't do the right thing then read that link that Browneyedbazzi provided.

    If that still doesn't work, you'll need to consider court action.
