Legal advice on stalker issue, please?

    I believe that the OP's previous thread covered all the advice as to how to deal with this sad situation. Now she has decided to report it to the police the OP's friend is worried about what the end result may be - ie. deportation. As far as I am aware deportation would not be considered unless the stalker was arrested, charged & convicted (a caution wouldn't be enough to consider deportation, particularly as he is not in the country illegally). Even with a conviction on his criminal record it wouldn't necessarily be a done deal for deportation to be considered or carried out - that would be something decided on or after sentencing at court and very few 'legal' residents get deported unless their crimes attract long prison sentences (ie. murderers, rapists etc). The OP's friend can ask the officer who will deal with her report as to what might be the final outcome but even they may not be able to give a definitive answer at the early stage of the investigation.

    His prior suicide threat and threats to move near her (mentioned on the other thread) would be something to be considered as potentially controlling behaviour and putting the victim in a clear state of "fear and alarm" - which would be taken very seriously.

    What the OP needs to do now is stop discussing this on a forum and get her friend some proper legal advice/assistance/support from the police or WA.

    I had some very nasty texts, calls, emails, etc from an ex once (in around 2002-3). He'd ring through the night, sometimes say something but mainly there'd be silence. He once wrote a nasty threatening (anonymous) 'poem' which he signed off as 'The Grim Reaper'. Said things about fire, and the stroke of midnight on a clock and I'd be taking my last breath - scared me enough to sleep with a bowl of water under the letterbox in case he decided to try to burn my house down that way. He sent a nasty email to my work about me with enough horrible insults in it for them to offer to take it further.

    Anyway, eventually I had a friend stay over and accompany me to the police station. I didn't have an address for him at that time, but did know where he worked. They went to his work and issued him with a warning. That was enough for him to leave me alone. Probably scared the life out of him. He was around 45 at the time!

    Hope you get this dealt with. Not to be taken lightly at all.
