  • Sorry to hijack this thread, but I was wondering whether or not a husband can be forced to leave the marital home for no other reason than the wife wants a separation??

    This couple I'm referring to have kids under the age of 10 & the husband works away during the week but comes home on a weekend.

    It isn't really a complicated scenario, but the hubby needs some reasssurance whilst he's waiting to see a solicitor.

    If the house is in joint names the husband can't be forced to go and has every right to live in the house.
    No reliance should be placed on the above.

    hmm not sure whether the house is in joint names but I know he has been the one paying the mortgage. What would happen if the house was only in her name?

    You just dopn't realise how bad these separations are until it happens to someone you know :(

    There are no automatic rights to anything at all in a divorce - each case is worked out based on the wishes of the couple divorcing and the individual circumstances

  • I'll pass the website address on, but don't think it's gone as far as divorce. I think it's looking like a separation at the moment.
