Does anyone know what my son's legal position would be if she did get caught?

No matter how you dress it up its stealing which amounts to theft! The possibility of a criminal record and all the reprecussions that go with it for a lump of cheese is laughable if it weren't so serious.
Your sons presence makes him an accessory, pure and simple whether he's with her when it's done or not he would be liable to arrest. Do/does they/he really want to spend a few hours in a cell, be fingerprinted, have DNA taken, be forever on the PNC, be marked for life ? They'd go through all of that regardless of whether their story was convincing and whether being charged or not................Then it gets worse.....job loss? house loss? !!!!

Good morning everyone. I've had a sleepless night and would be grateful for some advice.

ds1 and his gf (both in their late twenties and have bought a house together) came round yesterday. I'm very fond of gf and thought she was a lovely girl although she does have some very different attitudes to me regarding money at times (she's been brought up as a bit of a princess and to value designer goods and the need to impress others above all else). However, she's also kind, caring, funny and very clever (graduate with a very responsible job) and most importantly, makes my ds happy most of the time. In turn, he is usually good at getting her to see sense and provide reality checks.

Yesterday ds was joking with me about money saving as I explained yet again about how to use GR vouchers at M&S (we had meal deals for lunch!) when he suddenly looked serious and said, "Well at least what you are doing is legal, unlike gf."

Gf laughed and said blithely, "Well all the hundreds of pounds we spend at Toscas they can give us the odd lump of cheese." It transpired that they use the hand-held scanners to do their shopping and gf thinks she is justified in dropping a few items (lumps of cheese being her favourite) into the trolley without scanning them. She seems to think this is the same as me using glitches etc and does not consider it is wrong.

I know that we all have our own moral line but in my book (and I'm pretty sure in the eyes of the law) this is stealing. I tried telling her that they do spot checks on people's trolleys when they use hand held scanners but she just laughed and said, "I know, they've done it to us but they only scan a few odd items and if they did find an item I hadn't scanned I'd just tell them I'm really sorry I must have forgotten to scan this." I tried reasoning with her and mentioned they could also look on CCTV or have store detectives so she might well give away the fact that this had been deliberate rather than an accident but she didn't seem to grasp the fact that she could be prosecuted, which in turn would probably lead to her losing the job she has worked so hard for.

DS said he refused to be part of this and wouldn't go anywhere near her when he knew she intended to do this. However, he would still be in the shop with her and they go through the tills together at the end as they usually pay half each. He thinks that as long as he isn't anywhere near her when she adds the unscanned item to her trolley that he is not involved and cannot be prosecuted. However, I'm really worried that ds could be implicated and prosecuted too.

Does anyone know what my son's legal position would be if she did get caught?

Am I overreacting or does anyone else think it's OK to add a few unscanned items to a trolley load? If I'm not overreacting, how do I convince her to stop doing this or my ds to refuse to go into the shop with her?

Sorry, this is not even borderline - it is shoplifting and would be prosecuted.

DS needs a serious word - he could be seen as complicit/a member of the shoplifting "gang" if he is going through the checkout/walking out with the trolley. They do have visible (and hidden) cameras and monitor Self scan/scan as you shop particularly because of the risk - it is only a matter of time before this ends horribly. Our T said they are not putting in the scan as you shop as they already have one of the highest levels of shoplifting :(.

It is no way comparable to glitches or using their APG/PP systems against them. I have a moral compass and can live happily with myself glitch shopping and even pushing the limits on APG (£100/10 receipts limit ignored) but putting in items and deliberately not paying? GF needs her head read - if they prosecute, they will make an example of her to deter others and demonstrate the integrity of their system - reputation, public humiliation, impact on career ...!

No Sanex mens deo and no Derma Repair in my store (and no kids bath either but without the deo it didn't really matter). Might look further afield but let's hope these aren't as obscure as the snakes were in some parts.
