passenger in a bus accident

nearly 8 weeks ago I was a passenger in a bus that collided with a residential wall. We (the passengers) felt at the time that the driver had been driving recklessly and told him so.
He ignored us and ultimately hit the wall. He called the depot and told us another bus was coming. I asked him if he had notified the police and he had not. To make matters worse I already had a fracture from an RTA earlier in the week and the temporary dressing was damaged and I had glass shards in it, in my hair and my face. I was most concerned about the fracture and asked if he could call a paramedic. He told me not to be such a 'f***ing drama queen'.

To cut a long story short I am claiming against the bus company, they have admitted liability but yesterday I received a letter from the police saying that they have insufficient evidence to charge the driver so NFA.

How does this impact on my claim? also what about the photos of the damage I supplied and the residential property? Curiouser and curiouser...:(

    Whether the police charge the driver or not has no bearing on your claim.

    As I am reading your OP, neither you nor any other passenger appeared to suffer any injuries from this accident. Your only worry was whether your previous injury was affected.

    The cast appears to be chipped with glass shards in it but from what you say it appears to have done its job by protecting your fracture as you make no mention of pain and only damage to the dressing.

  • The best course of action here will be to advise your solicitors who are dealing with the initial RTA as they will need to be aware of it.

    What they will most likely do is make an additional claim to the bus co in order to be compensated for any aggravation the bus collision has caused to the original injuries and any losses that arise from the 2nd incident. They can also commission just one medical report to comment on the inter-play of any symptoms between the 2 incidents.

    Like the driver, how do you know? He denied his passenger medical treatment when requested to do so. I sincerely hope the op takes the company to the cleaners for this.

    I am in terrible pain and having physio 3 times a week as the whiplash and the original cast had to be reset. I didn't include all that for the sake of brevity in my OP - didn't want to bore you all. I was sitting on the side of the bus that took the full impact. I saw my surgeon on Thursday who has said that my fracture has not healed as he would expect and I asked him if the bus accident may have exacerbated things and he said yes...

    Thank you for the replies, I will email my solicitor to ensure they are fully aware of the 2nd accident as I am not entirely sure if they do, I have had so much correspondence lately so need to clarify.
