Defaulted twice for the same debt

A bit of a long one here I'm afraid.
In 2004 my marriage broke down as did the finances. He went bankrupt I tried to muddle through and make payments however small. Everything ended up with CCCS, now Step change. Obviously ( or not kW it would seem) I defaulted on everything. Time marches on and in March this year all defaults left my credit report.
About 2 months ago I received a letter at my new home from MKDP looking for me, I took it as a fishing expedition and ignored it. Next thing I know there is a default on my experian file.
I contacted Experian and eventually MKDP. It turns out this is for a Egg account that they say defaulted in 2012. They do concede that the account has been with Stepchange since 2007.
My question is twofold,
How can they default me again? My research has shown that egg were very proactive when it came to issuing defaults. I have a paying in book for Moorcroft that shows that I was paying them for the debt before it went to CCCS. In my mind the debt has defaulted and cleared. I have sent them copies of everything I have but no reply....

Now we did have two egg accounts, both went to CCCS well low and behold I have now had another agency get in touch saying they are chasing me for the other one, or at least I think it is the other one as the reference numbers seem to change almost monthly, even with the same DCA. Is this coincidental?
I have also had yet another 'fishing ' letter yesterday from Pace Forward looking for me.

I should ad that my previous address is owned by a family member who passes me every single bit of post, even junk mail so I know that no letters have arrived there for me regarding this or any of the latest letters.

Sorry if this is long winded and I hope it makes sense but I really feel a bit trapped...

    i have a similar issue so i presume they can do this, most of my debts are from a long time ago, fell into arrears about 5 yrs and went with sc as well, now all of the original creditors are off my files but the dca's are on there showing defaults, so now for a further 6 years or more as they are marked as ar i am stuck! seems pretty unfair but 3 out of 5 creditors have done this so i presume they can
    goal for 2014....i will manage money better ..must resist shopping..............:A

    Do you have copies of your credit reports showing what was previously showing in your credit reports regarding this account?

    Several things to bear in mind here.

    - IF there was a previous earlier dated default on your reports, then a debt collector or creditor is NOT allowed to add another more recent one.

    However, many debt collectors and even mainstream creditors break the rules and add 2nd defaults.

    You have to argue hard, but you can get these removed.

    - If there wasn't a previous default, for example it had just been listed as an arrangement/DMP or behind by x months payments, then they can record a default, but you may be able to dispute the date on the grounds that if they were going to add a default then to be accurate it should have been added way back within say 6 months of you entering the DMP.

  • Thanks for all of the replies. I do t have previous copies of my report. Is there a way I can obtain them? I do pay Experian monthly so that I have access at all times to monitor things.
    I have a feeling that it is going to be a long hard struggle and that as one of you mentioned a few may try the same thug with me.

    It seems unfair that they seem to have all of the rights. Even in a court of law you can argue your case before being found guilty....
