It was just their guidance on the legislation.

The actual legislation section it comes from is Unfair Contract Terms ACt 1977 and it states:

(1)To the extent that this Part of this Act prevents the exclusion or restriction of any liability it also prevents—
(a)making the liability or its enforcement subject to restrictive or onerous conditions;

After mentioning SoGA, I received a rather pointed email saying that they did indeed understand the SoGA. However (sic) they will consider a refund in my case

So, all thanks to you guys, I got a refund ! Thank you all
