thankyou, there area couple of things of particular relevance to me here (even though the OFT closed in April this year unfortunately), so again very useful. I'll report back on their decision !
It was just their guidance on the legislation.
The actual legislation section it comes from is Unfair Contract Terms ACt 1977 and it states:(1)To the extent that this Part of this Act prevents the exclusion or restriction of any liability it also prevents—

After mentioning SoGA, I received a rather pointed email saying that they did indeed understand the SoGA. However (sic) they will consider a refund in my case
