comps that only accept entry if you opt in to mailings etc against DPA?

shortlist / mr hyde is the main one I can remember, and now OK -
I thought the whole idea of DPA was to allow opt OUT of marketing.. these give you no choice, if you want to enter?

They're very annoying esp those which give you the option but won't let you enter unless you tick the box.0

Shortlist/Mr hyde gives you the choice, text entries (which are a premium rate) do not require an opt in.
It maybe that as opt-in is a condition of entry there does not need to be an opt-out as that is simply the option not to enter?
There are also quite a lot of newsletter signups where there is no opt-out option beyond not entering.0 -
