I have today received an offer of my payments to the above, my query is, are theY allowed to pay off existing debts on the said card, IE, if you are in debt with the payments, i Have an agreemant set up with a third party, which, has been paid successfully according to the agreement.
My argument is, these pAYMENTS WHICH ARE DUE BACK TO ME, SHOULD COME DIRECT TO ME AS THEY WERE not MEANT TO BE TAKEN IF THE FIRST PLACE, SO THEREFORE SHOULD NOT BE USED TO PAY THE EXISTING DEBT....
Sorry about the shouting.

If you are in arrears, yes, they can set the refund off against the debt.0

But, i am not, technically in arrears with them....they have put this debt in to the hands of a third party.....and this is my money not there's to do what they want with.0

If you've defaulted, then they can deduct the refund from what you owe them.0

If there are arrears, defaults or there have been amounts written off as part of an agreed settlement, then the lender can use the redress against those.
Where a debt has moved to a third party, if the lender has the abilty to claw the debt back or the third party is only acting as an agent for the lender then they can use the redress against the unpaid debt. Where there is no further relationship between the third party and the original lender (i.e. no return of the debt and/or not acting as agent) then the lender has to pay the redress to you.My argument is, these pAYMENTS WHICH ARE DUE BACK TO ME, SHOULD COME DIRECT TO ME AS THEY WERE not MEANT TO BE TAKEN IF THE FIRST PLACE, SO THEREFORE SHOULD NOT BE USED TO PAY THE EXISTING DEBT....
Alternative view is that you never paid the premiums in the first place as failed to pay all the debt and therefore the refund should not come to you. However, my comments above give you the correct position.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. I have been having a difficult time getting a payment break refund calculation from Monument. I originally contacted their customer service department in May and was told 8 weeks to receive a statement. This didn't arrive:(.
I contacted them several times and was told it was being processed and to wait a few more days etc.etc.
After much hassle and difficult conversations I was give a number for their customer relations (not services) deprtment and was told that whilst customer services had logged my call they had not actually passed thin information on to the appropriate people!
I have now been told that I will have a statement of what they owe me within 7 days - let's see.
If you would like to make a claim the customer services department can be contacted on 0870 333 5487. You need your 16digit account number and password to get through.
If you are having problems with your claim then you could try their customer relations department on 0129 322 8702. They work 9am - 4pm Monday to Friday.0 -

I haven't read th entire thread on the banruptcy board so if you are still not bankrupt, put your complaint in before you are because otherwise, if you were to receive any redress it would have to go to the ORNon me fac calcitrare tuum culi0

How far back can you go with the PPI as my account was quite some time ago?Thriftkitten
