Royal Mail Compensation

Hi

I hope somebody can help.

I posted a parcel using International tracking to my son who is working in magaluf, I paid extra compensation to cover for £100, inside parcel were a new electric razor, 2 t shirts and Xbox cable. Royal mail charged me £22.14 in total, everyday I checked the royal mail website so i could tell my son when he would expect the parcel, the so called Royal mail tracking just said what post office i used and when it left country, I continued to track, Correos ( spanish postal service) tracking was no better.
After tracking the Correos website was updated and just said delivered but my son had not got the parcel.

My son was later told after some investigation, that a parcel was left outside apartments and was obviously stolen. Royal mail are saying that because Correos said it was delivered then it wasn't lost but it wasn't delivered to my son's apartment. Furious is an under estimation as I really did believe we were covered and already gave my son the £80 for the 2 t shirts he lost and i'm out of pocket for a new razor i bought him and the original postage so all in all about £120! I might as well of got the items put them in a pile and set fire to them. I have asked Royal mail for the proof of correspondense/investigation they are suppose to have had with Correos.

Does anyone know where I stand on this, I thought my contract was with Royal Mail and I know the parcel was not delivered as my son was the one waiting for it, why would he say he hadn't recieved his own stuff!

I want to take them to a small claims court as I am fuming. If anyone can help would be really grateful.

    Your son needs to claim/pursue Correos
    RM have no power over Correos and their delivery method/standards.
    You may 'know' it hasnt been delivered but how would RM?
    Im not really sure what tracking you expected in the UK beyond what was there,after the UK its down to the countries carrier to provide the forward tracking.

    Well you may think so. However the recipient can claim in the UK,so why not Spain?
    Correos are stating the item is delivered and the tracking reflects that. So what is your advice to the OP?

    The item hasn't arrived and IMO you are entitled, within the limits of your compensation, to pursue the Royal Mail for the replacement costs of the items that you sent. The Royal Mail aren't under any obligation to provide evidence to you, but IMO they would have to provide that evidence to a court. You can't pursue Correos as you have no contractual arrangements with them.

    IMO the judge who presided over the small claims court track case would decide whether the item was delivered under the terms of the contract. I suspect the Royal Mail would settle on this before a court case though.

    A courier can argue that an item has arrived, or been delivered to the apartment block, or whatever, and that case might be valid. if a courier delivers to a concierge and it's lost then that's a different matter, but IMO the courier is going to have to explain to the court exactly what has happened. The judge will go on balance of probabilities, but I'd personally pursue it.

    There appears to be two international tracking services offered by Royal Mail: Track and Track and Sign.

    If the OP paid for Track and Sign and there's no Sign, RM is clearly liable because they haven't fulfilled their part of the contract. The fact that they used a sub-contractor is immaterial.

    If the OP paid for only a Track service, I guess it's a case of kicking up as much fuss as possible and hope they cough up. :):):)
