Ukcps parking charge

I just want to clarify things a little. My vehicle received a UKCPS ticket for parking on private land without the relevant permit yesterday 8th July 2014. In England and its registered to me.


I have spent hours looking through the site and from what I have understood.


1). Ignore the ticket and wait for the notice to keeper which should arrive between days 29 and 56. If its outside this time then they have breached conditions.


2) If it arrives in this time then send the prepared letter as on the MSE forum and edit the company and ticket number accordingly.


Making sure to sign it as the registered keeper.


3) When they refuse/decline the appeal which they probably will then they should have sent me a POPLA code.


4) If it gets to this stage then send an appeal letter to POPLA.


Do you have draft POPLA appeal letters on the forum?

    You have pretty much got it right except you print your name, not sign it, and write Keeper underneath.

    Appeal anyway even if the NTK arrives outside the proscribed time limit.

    The Sticky thread for Newbies has the first template letter and a load of POPLA templates you can copy and adjust as needed. Follow the How to Win at POPLA link to find the templates. There should be one for UKPS but if not, use the search facility using the keywords "permit" and "UKPS". If that doesn't provide you with something suitable, widen your search with permit and parking ticket.

    Post your redacted POPLA appeal on this thread before you submit it for the good people here to check over for you.

    Hi Neil,

    That's mostly correct but would just add

    1). Ignore the ticket and wait for the notice to keeper which should arrive between days 29 and 56. If its outside this time then they have breached conditions (which doesn't make it null and void it just gives the keeper an extra appeal point)


    2) When it arrives, in whatever timeframe, check it against POFA schedule 4 paragraph 8 - if it meets the requirements laid down there send the 1st appeal template letter as is.
    If it doesn't meet the requirements (only one of which is the time frame it must arrive within) then add point 4) Your Notice to Keeper does not comply with the requirements of POFA Schedule 4 therefore you have failed to establish a right to pursue the keeper.

    Thanks for the replies, as I thought.


    The only other question is what to do if no demanding letter is received at all.


    So basically the only thing that has been issued is a ticket on windscreen.


    Do I just leave it or do something else?

    If they never send a Notice to the Keeper then there is nothing for the keeper to do.

    They could only pursue the driver and they have no idea who that is.

    And you're far too intelligent to tell them when you're not obliged to ;)

    Could anyone please advise attach a link for a recent POPLA appeal letter which has all the relevant points in and the following point which is raised elsewhere in the forum.


    A rebuttal to include in any POPLA appeal now (June 2014 onwards) regarding 'PE v Beavis' and about any reference to 'commercial justification':


    I m getting things ready for my appeal letter is rejected and have my popla letter ready.

    use tinypic or photobucket to host them

    then add a broken weblink to each one on here (miss out http for example)

    If so, the two threads will need merging as it helps the forum members to best help you if all the info on a parking charge is on the same thread. I'll ask a forum guide to merge them.

    UKCPS sometimes attempt to use a different business model to parking eye as they try to claim the charge is a contractually agreed sum and we will need to the see the signs to best advise you on POPLA wording.

    The wording in your NtK when you receive it will also need to be checked.

    I cannot link the photos because I am a new forum member so I will type word for word as follows.


    The signs are not on the entrance to the alleged private parking area/property, they are only on the building wall about 15 feet above ground and approximately30-40 feet away from where you drive in so you cannot see them when you drive in.


    Signs as follows.

    PRIVATE LAND
    CONTRACTUAL AGREEMENT
    THIS LAND IS STRICTLY FOR THE PARKING OF MOTOR
    VEHICLES THAT COMPLY WITH THE FOLLOWING
    CONDITIONS INDICATED BELOW
    PERMIT HOLDER ONLY
    VALID PERMIT MUST BE DISPLAYED INSIDE THE
    FRONT WINDSCREEN IN FULL VIEW
    IF YOU PARK A VEHICLE ON THIS LAND AND ARE NOT LISTED
    IN THE CATEGORY LISTED ABOVEYOU ARE CONTRACTUALLY AGREEING TO THE FOLLOWING:
    WHICH MAY BE ENFORCED AT ALL TIMES DISBALED BADGE AND MOTORBIKES NOT EXEMPT

    It then just mentions that it may be monitored by camera or foot patrol.


    But I know its foot patrol and not camera.
