Hi in May 2013 I bought a Kurio kids tablet from Debenhams online in the sale (it was a good saving) and put it away for Christmas now it seems the Tablet has crashed won't switch on and doesn't even appear to charge today I have rang Debenhams customer service I was told I would need to take it into store and considering it's faulty it is upto the store wether they replace or refund.
Where do i stand considering I have now had the product over a year even though my daughter only recieved it on Christmas day I can't seem to find any boards/posts covering a similar problem.

That explains the Law. Once it is more than 6 months from purchase date then the retailer can require the consumer to commission a report to prove the fault that occurred was inherent (present at the time of sale but not apparent). So even if you'd bought it in December you'd still be (potentially) in the same position. (The cost of the report is refunded by the retailer, if it finds an inherent fault).
But it is time elapsed from purchase date that matters, not time from when you gave something as a gift. (Unless the "gift" aspect was clearly made aware to the retailer and formed part of the contract of sale).
Just go and see them, but don't go in shouting "I know my rights!" (when you clearly don't). You catch far more flies with honey than with vinegar.

Thank you yes you're right I don't have a clue I won't go shouting the odds may try the " how do I explain to a 6 year old that Father Christmas gives dodgy gifts and can't replace them!" she's still at an age where he can perform miracles fingers crossed!!0

Thank you yes you're right I don't have a clue I won't go shouting the odds may try the " how do I explain to a 6 year old that Father Christmas gives dodgy gifts and can't replace them!" she's still at an age where he can perform miracles fingers crossed!!
Slightly off topic (but less off topic than other posts, it appears), but when I worked in retail, this exactly happened. A faulty tablet as a Christmas present, except the mother marched her 6 year old in and shouted at my manager that he had ruined her Christmas and now she knows Father Christmas isn't real because she has to bring this tablet back and she was screaming saying 'You tell my daughter that she has to be without her Christmas present. You tell her that Father Christmas isn't real'
The poor girl was in hysterics.
I couldn't understand why the Mum hadn't just said we need to take it back to the shop for Father Christmas to pick up and fix...0 -

Shouldve told her to write a letter to "santa" requesting he check toys are working before wrapping them to avoid that type of situation.

Hahah, I found most employers are more reasonable.... Despite what any one says about the customer always being right, there is a definitely an appreciation that customers are generally misinformed and often erratic and irrational. But they're the best kind of customers. They make a day in retail worthwhile
