Hi,I had received a parking (charge) in scotland. The cost being £100 in full or £60 if paid in 14days, the charge was placed on my window screen .I had been away for approximately 20-30minutes after returning to find a ticket which initially I had not realised I should of placed . After I had then seen the notice board (thinking I hadn't paid my ticket) it then upset me further to realise that if I had only displayed a FREE TICKET FOR TWO HOURS for parking for FREE then there after 3hours you had to pay . I don't know what was worse the fact it was free in the first place or failure to show a (FREE) ticket . No one can afford this amount of money ,I would of been more considerate if I hadn't paid for My parking ticket but my confusion is towards the fact I'm being charged £60-£100 in the two free hours which I was completely in . I hope you haven't paid it or contacted them.
There is no liability for the registered keeper in Scotland and you should ignore the charge.

Unless you inform the PPC who the driver was, there is no prospect of them finding out. Unlike in England and Wales, where PPCs have access to the DVLA database for them to chase the Registered Keeper where they don't know the identity and address of the driver, Scotland and NI are not covered by the Protection of Freedoms Act 2012 which provides for potential RK liability.
Just ignore anything further from them - and never reveal who the driver might have been. (For any newbies reading this thread 'ignore' relates only to Scotland/NI).Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

On top of that, they can only claim for losses directly related to your parking. Since it was a free carpark they could only claim for £0.0

Following on from this post . I have now received (or rather the registered keeper has now had final reminders ,they have the address and a photo of the car . The registered keeper o's panicking as they say if it goes to a sheriff court hos credit rating could be at risk . Not only to mention . The amount is now £160 .. worried and nervous!!!!0

Worried by what? A nasty letter? 'Cos that's all it is. No parking company has EVER taken someone to court in Scotland. Just file the letters and forget.Je suis Charlie.0

Stop worrying. Tell the registered keeper to come here and read advice. There is no keeper liability in Scotland so no keeper will be taken to court.
It is all hot air. As long as the keeper does not name the driver, then there will be no problems.
