Can I get reimbursed by my credit card for car hire excess?

My last car hire I decided not to take their full excess cover insurance and when I brought the car back there was a scratch (which I did not cause) - I had to pay €350.
Can I get this money back under section 75 of the credit card agreements?
Thank you for your help.

I think it's unlikely as, by not taking CDW, you accepted personal responsibility for the damage.0

This is why private car hire insurance is useful, you can get covered for like £30 a year, and you're covered in case the rental people decide they need some extra money.Credit 'Score' - Don't buy the credit 'score' that Experian, Equifax and Noddle want to sell you. It's an arbitrary number that means nothing when it comes to applying for credit.
ALWAYS HAVE A DIRECT DEBIT SET UP FOR THE MINIMUM PAYMENT ON YOUR CREDIT CARDS, REGARDLESS OF WHETHER YOU PLAN TO LOGIN AND PAY EACH MONTH.0 -

Where do you feel that there has been a misrepresentation or breach of contract that would allow you to claim under section 75?75. — (1) If the debtor under a debtor-creditor-supplier agreement falling within section 12(b) or (c) has, in relation to a transaction financed by the agreement, any claim against the supplier in respect of a misrepresentation or breach of contract, he shall have a like claim against the creditor, who, with the supplier, shall accordingly be jointly and severally liable to the debtor."We act as though comfort and luxury are the chief requirements of life, when all that we need to make us happy is something to be enthusiastic about” – Albert Einstein0 -

At a stretch, if the OP knows for a fact the car had the scratch when it was given to him, the misrepresentation would be being told he's liable for damage caused while he has the car and then charging him for damage caused before he got it.
Proving it, however, is another matter entirely.0 -

He didn't say that - he said he didn't "cause" the scratch, which was there "when I brought the car back" ..............If it was there when he collected the car he should have brought it to the attention of the hirer at that point.0 -

I'm aware, which is why what I said (and you quoted) had the crucial word "if" at the start.0 -
On a recent trip to Germany I took out an excess policy from a link here on Martin's site. Cost was £13 for seven days versus €140 if I bought Avis' own policy.
The only downside with separate policies of this nature is that you have to bear the cost of the excess, if you do damage the car, in my case it would have been €1100 had I damaged the car, until the insurer coughs up, versus Avis' own which doesn't charge your card.
I don't normally buy these policies and normally risk it but heard that German rental firms, particularly Avis, charge damage if you so much as fart in the vehicle.
As it happened I didn't have rectal gas, so wasn't charged.Never argue with an idiot. Especially not this idiot because I'm always right anyway.0
