DJ cancelled - getting deposit back

Bit of a long story but basically had a party booked in April this year for my DD birthday.
Dj cancelled a few days before due to his wife giving birth.
Not a problem there, that cannot be helped hey!!!
BUT I have called him about four times since to chase the deposit....each time he said that he will put it in the post and hasn't
So, what the hell do I do, in my mind its MY money as he didn't do the job. Its £50 not a massive amount of money but still an amount that I dont just want to give away.
Do I leave it, keep phoning and risk being done for harrasment!!! or turn up on his door step....just found his address this morning when I was having a clear out. or what else??
Your advise would be appreciated (I woke up at %am worrying about this!!!)

    I'm shocked the DJ behaved like this. My hubby is a DJ and we recently had a baby. He warned people booking around the due date, that it might not be him doing the disco, and would have paid another disco to cover it if needs be.

    Anyway, I would write to the DJ saying you require the money back within the next 14 days otherwise you will be forced to take further action. Send the letter recorded delivery, so you can prove that it was received.

    If he still doesn't return your deposit, contact Trading Standards who should be able to help.

    I know I am shocked...esp as he is a friend of a friend of a friend!!!!! The baby was prem so I let it go for a few months but now it is really starting to p*ss me off!
    I thought of trading standards but wasn't sure if they would be interested...its just the principle really and also £50 is £50!!
    Will get on with a letter this morning. Thanks a lot

    This guy might be a friend of a friend of a friend but you still had a business contract with him which he has broken.

    Beccles is right, he had the responsibility to find cover. However, prem babies ARE unexpected so under the circumstances, he probably wasn't in a position to sort it out but I think that you have been compassionate and understanding beyond what would be considered necessary and need to get a bit more formal.

    If your worried about upsetting your friendships then make sure that your friend and your friend's friend are in the picture, maybe a little nudge might sort it out before you need to get threatening?

    Yes, I tried that one with the friends... I had lost his number so had to ask her again... they told me that he was out and about again and that the baby was OK.
    Thanks for your advise both....Just wasn't sure how to handle it and didn't want to do anything that people/friends would think was out of order.

    Why not ring him at home (thus making sure he's in) and suggest you pop round right then for the money, even better ring from your mobile and say you are passing and will pop in. Dropping by with a 50p congrats on the baby card would give an excuse too.

    The only thing with that is the baby was born in April!!!
    Every time I have called at home it always goes to answerphone....what I was thinking of doing was popping round with my brother...he used to work as a bouncer and is build like a ......if that does work, I dont know what will !!!
    Think I will go round first and then do the letter if it doesn't work, also will ring TS just incase he has done it to others

    Hi

    I work as a DJ and I had a problem getting money from an agent for a job i completed......it went on for months and I got every excuse in the book..cheque sent / resent / on holiday etc

    In the end I rang the guy up and said that i had got big problems from a loan shark that kept coming round to beat me up because I couldn't pay him ( not the truth - I just wanted my money )... I told him that they were coming round on wednesday evening and that I was going to give his ( the debter agent ) address and contact details to the guy so "I didn't get beaten up" and told him that I expect the guy will come and collect the money directly.....

    The money was paid into my account the same day in cash and he asked me not to give his details to my imaginary loan shark !:rotfl:

    Been so busy with the kids, havn't got round to a letter. Have just done this...what do you think??

    I spoke to you at the end of January this year and booked your services to DJ at my daughters birthday party which was to be held on XXXXXXX. I sent you a cheque for £50 at your request as a deposit.
    You called me on the Monday 10th April to advise me that you would be unable to attend and as I had paid a deposit this is a breach of contract on your behalf.
    I have contacted you on numerous occasions over the past two months to ask for a refund of my £50 deposit and to date I have not received it back.
    I am now giving you a deadline of 14 days from today for you to refund this back to me. If I do not receive the monies within this time I will be forced to take matters further and seek legal advise.

    You can post the cheque to me at the above address.

    perhaps change legal advise to court action but apart from that looks good!
