request ccas, debt suddenly gets passed back to the original lender

    The CCA for my mortgage loan has been sent to me. It looks genuine. Guess I am screwed on that one? They didn't even take the £1 payment for it!

    I haven't seen a lot of CCAs reviewed on MSE. That is something that people do on CAG a lot more. I would consider posting it up there for review.

    What month/year did you take this loan out?

    If they have given you a photocopy of the agreement that you signed and dated (and signed by them) along with all the terms and conditions from the time you signed it, then it it likely to:
    a) be enforcable
    b) to have met your CCA request

    If they have sent you a reconstruction then it may have met the requirements of your CCA request. They will usually say if the original is not available if they sent you a reconstruction.

    If the original is not available then it is not enforcable (for a pre April 2007 debt).

    If you have any doubt then I would pop it up on CAG.

    It is the correct one, signed and has all the terms. !!!!!!. Just have to hope they will accept a settlement offer
