No. Although the judge will look at the balance of probabilities it is also upto you to provide a 'burden of proof' that he was not going to do that work which you carried out. You can't do this.
My burden of proof will be the fact that he charged extra today to finish off work that was already included in the quote. Had the bath not been built, he would have charged extra to have built/connected it up.
I agree that had he not charged any extra today, then there would be no issue, as he could easily say that he was going to build it today as the quote stated - and I wasnt expecting any money back for building it,however as he did charge extra, I thank my lucky stars I did it myself otherwise he would have charged at least an extra full days labour to do it.0 -

I wish you luck. But if you'd have allowed him to do it - which he would have done no doubt. Then you would have either not had to pay him or could have claimed the money back.

Thanks stebiz, as always on this board, theres always a differing of opinion. If it gets to that stage, which I hope it dosent - it will be for the judge to say yay or nay.0 -

It wasnt part of the plan, but looks like we might have to now!
We had old skirting boards in there and the fitter gave us a few options when he came round to quote:
1) Keep the old skirting (This was grotty and had seen better days)
2) Have it totally plastered
3) Have a new skirting fitted
We went with option 2 - however had no idea it was going to look like it does now!0 -
