Not sure how this applies to private nurseries, but in schools the parent has the right to choose where the child goes (whether mainstream or SEN) and if the parent chooses to send their child to mainstream they have to accommodate the child, no matter what.

We currently have a almost 4 year old, on 2:1 care, and he only comes in for an hour a week because he cannot cope for longer. He is much bigger than the other children and does pose a risk to them, hence 2:1 and not in for much, and mostly kept on his own.

We have 'suggested' that he would be better in a SEN school where they are more equipped for his needs, but that is all we can do, suggest. The final decision is up to the parents.
