A quick google seems to suggest that if proof of posting if provided, then it is accepted that delivery is made 2 days later.
Many examples of posting the change of ownership to the DVLA who, subsequently 'lose' it and claim it was never sent and fine you. Providing proof of posting to the court has resulted in the fine being cancelled.
Also, in the link below, someone sent their tax returns via Royal Mail, that HMRC deemed arrived after the cut-off point. Providing the proof of posting caused the tribunal to accept that HMRC did receive the tax returns 2 days later.

That link is probably referring to the "Interpretation act", and it deals specifically with documents that have to be posted.References to service by post
Where an Act authorises or requires any document to
be served by post (whether the expression “serve” or the expression “give” or “send” or any other expression is used) then, unless the contrary intention appears, the service is deemed to be effected by properly addressing, pre-paying and posting a letter containing the document and, unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of post.

thanks everyone for the various responses, seems to have divided opinion. The item in question is a musical instrument that would be in a box 600mmx600mmx300mm ish plus a small guitar type amp. We are talking £160.
I have not paid for the further item from the seller yet, but I like the idea of returning it as not as described to get a postal address0 -
Also, have requested that the item is delivered by Mon 7th July, or at least for the seller to provide me with concrete proof that is has been sent i.e. trackable carrier number0

I had a seller refuse to give me his address - but i noticed he had BOUGHT something too - so contacted that seller and got it from them :rotfl:.
Ebay will give out an address IF you send a solicitors letter to their OVERSEAS office. You may need a crime ref number too.
But buying an item and asking for a return may work - IF seller has used a real address. Had a fake seller other day using a mail etc address, and another using a business park address - but no unit number. Also, Ebay allow sellers to put a different return address on their first ever return.0 -
Have already tried contact one seller that he had bought from to no avail. But yes there are others that I could try0
