parking fines NCP/legal action threatened by Gordon & Noble - Help please!!!

I've had several parking fines from last year for parking in an NCP car park in Glasgow. I thought at the time it was free after 6pm. I had only paid up until such time. I've had debt letters from Newman and Zenith and now it seems like it's been passed on to Gordon & Noble who are sheriff officers/debt collectors. I've had many voice messages left on my answering machine threatening legal action if I don't phone up and pay. Do they have the power to take me to court? What should I do??

    these are not fines for a start, that is an f word

    they are speculative invpices and they can only take the DRIVER to court in scotland, so most people dont tell them who the driver was

    read the NEWBIES sticky thread at the top of this forum, paying particular attention to the SCOTLAND parts

    It's just that they're sheriff offices so it's giving me the frighteners. I'm getting voices messages left every single day telling me that this issue is not going to go away and he has the power to take this further and will if I don't call him back. Do I just keep ignoring him??

    if they know that you are or were the actual driver on the day then obviously court proceedings may follow (I did tell you this)

    anyone can go to the small claims court for an unpaid invoice and that is for 5 years in scotland, so obviously they could do this if you were the driver and they know and can prove you were

    if you are the RK and were not the driver then you cannot be forced to name the driver so as long as you havent given this away if you were then the onus is on them to prove their case, taking the driver to that court and proving all the claims are valid (locus standii , contracts , signage etc)

    nobody can tell you about your individual case as only you know these facts , so only you can decide on what to do next based on what I have outlined

    You are not OBLIGED, to give anybody your details, you have the RIGHT to remain SILENT. NEVER TESTIFY against yourself. SO REMAIN COMPLETELY SILENT as is YOUR RIGHT. They are making this CLAIM, they have the BURDEN of PROOF. NO NAME, NO PROOF LOL. Just REMAIN SILENT as is your RIGHT. Your NOT OBLIGED to give them ANY of your DETAILS. FACT ! Don't even RESPOND to them simple really. YOU DONT HAVE TO. LOL

    I think you will find the calls actually come from the non-sherriff officer side of their operation, so its just an attempt to scare you.

    Many Scottish collector firms operate this way - with a legit/court appointed firm and a bunch of cowboys subsidiary.

    The previous recent Gordon and Noble threads here demonstrate that your guys are of the wild-west variety.

    Keep-on ignoring them is best but if they are making-up the laws to suit themselves again, a complaint to the appropriate authorities is very much in order!

    If the 'voices' are concerning you, just disconnect your voicemail for a few weeks and see what happens then.

    Just don't make any contact with them at all - they are trying to intimidate.

    Whilst Gordon and Noble appear to be able to enforce judgments as Sherriffs - THAT IS ONLY AFTER A COURT ORDER HAS BEEN OBTAINED.

    Gordon and Noble also act in the early stages as the bog standard DEBT COLLECTOR

    Many modern digital home 'phones have the facility to block numbers, see if yours does.

    Your 'phone service provider may offer a similar service, I know BT does, although I think there's a charge for it.
