I have been through the early process of trying to get my charges back from Natwest and they have now replied to say they intend to defend the claim and ask for more information. They want an indication of the amount I think I should have been charged for each item I'm claiming. They also want further information about all facts relied upon in assuming that the charges are an unfair penalty and for me to identify the regulations of the unfair terms relied upon in the claim.
This all sounds like tactics to put me off- and frankly i'm so lost as to where to start they might just achieve their goal!
Has anyone else been asked for this kind of info before? What do I need to say in reply? Help!!!!
  • firstly most people have been asked the question before. Did you file through Money Claim OnLine or N1 paper form? If so, when the case was allocated to your local court did you take two copies of the list of charges?
The letter you have received, is it from the court or Cobbetts?
I have not worked for NatWest Bank since February 2009

  • Martin, I followed all your advice/templates to ask Barclays to refund bank charges. I also used your template for claiming via online money claim. Barclays have posted their defence for the whoe amount (surprise, surprise) and state that no account details or breakdown of charges were included in the claim. Any ideas how I can provide this info - or have I done something wrong on the initial claim form? - they have had all the info by letter previously.

They are just trying to spin the claim out so you might accept less money. Don't worry about it no bank really wants to go to court and knowing that gives you the upper hand! Don't accept anything less than 100% + Interest + Court Costs!

You don't need to reply to the bank's defence and logically they must have your account details or your claim wouldn't have got this far.

Should you receive a letter from the court then you must reply to them with your breakdown of your charges and any further information they ask for.

You now need to wait on a hearing date and further instructions from the court.
