Please help me! Cosatto refusing to refund faulty pram

Hi,

Hoping someone can give me some advice please. I bought a cosatto giggle pushchair in november 2013. Previous giggles (Ironic name...) had been recalled but the pushchair I bought was not affected (checked batch number when I bought it).

Tuesday I took my daughter into town in the pushchair and it collapsed on a busy road :-( luckily unhurt. and happened again on the way home. So scary :-(

Rang cosatto - told me no refund they would just repair it. Told them i was not happy with this as it could of caused serious injury to my daughter and i just want a refund. Definite no from cosatto as its repairable (pushchair has only been used 4 1/2 months as baby born end of feb, in my opinion a new pushchair should need no repairs!).

Rang boots who I bought it from and they have said cosatto have offered to fix and they are happy with that.

since checked my batch number on cosatto website and it comes up that product needs inspection. As this would mean sending it off does this count as a recall?
Boots will only refund if its been recalled.

Unsure where I stand. I couldnt bear to put my baby back in the pushchair. It was so scary and I'm worried after its been fixed it would happen again

Also I should add that I dont know when status of the pushchair went fr unaffected to potentially unsafe (if it was before Tuesday I'd be absolutely fuming as they have all my contact details from the product guarentee).

    Not sure it is the same for prams as it is a safety aspect but I imagine it will be (someone will correct that if. I am wrong, I'm sure), but as you have had the pushchair for over 6 months, it is up to you to prove it is inherently faulty before they even have to do anything. Even then, they can offer either repair, replacement or refund at their choosing. Your contract is with Boots as they are the retailer and if Cosatto offer a warranty then this is in addition to your rights. If their warranty states a repair, that's all you will be entitled to.

    As. I said however, I am not 100% this counts in regard to something with a potential recall.

    A recall for checking or modification would not normal entitle a refund.

    My cars been recalled twice for repairs, its 10 years old, can I have a refund!
