if it passes the brake test on the MOT the tester generally doesnt care unless the disc is so cattle trucked they fail it
Even then, it depends on how visible the disc is without removing the wheel (which the tester doesn't - can't - do). And, with a dust shield behind and a fairly closed-in wheel in front, can be "not at all".
The MOt standard for brake disks is far lower than most people realise. here's a video from the VOSA training department that gives an idea of just how bad they can be while still being safe:

Similarly, my kitcar went for MOT with the front brakes binding (needed new callipers). It was so bad that you did not need to touch the brakes to stop and turning the wheels was impossible by hand.
The tester could not fail the car for this, despite the danger of overheating the brakes, the brake fluid, the wheels and the tyres.
MOT should never be taken as a sign that your car is perfectly ok.
