Halifax CC - online agreement

Hello,

Firstly apologies for what for some will be very obvious answers by now.
I have banked online for several years and have always applied for credit cards online. I took a Halifax credit card out in July 2007. I realised last week that the payment protection that shows on my statement from time to time could be PPI and Halifax confirmed this via initial phone call to them last week. They have set up the complaint and sent me a letter which I need to complete within 14 days or call for an extension.

I have read the sticky thread but I'm unsure of the order you follow:
Do I need to obtain a SAR from Halifax before I claim, or wait for an initial letter back from them?
Does anyone know if at that stage the policy was an opt in or opt out pre ticked box feature for Halifax?
As I was in full time employment at the time of applying, with 14 years tenure so I would have been covered for sickness and redundancy for a nice sum so the policy wasn't needed.

Please could you give some guidance to the above as to next steps and wether my claim will just be rejected because it was taken out online.

Thanks in advance for your help.

Most people don't need a SAR. its typically only needed by those that dont have their own records and dont know if they had PPI on the contract and dont want to ask the lender directly.

I dont know but by 2007, it was known that the ombudsman didnt like pre-ticked or tick to opt out style forms. So, its unlikely. However, Halifax will be able to tell.

Doesn't matter on non-advised online cases. Only if the online process has mistakes (such as bad or inadequate wording) will that come into play.

The odds of success are much lower as you bought online as no-one sold it to you. you are largely reliant on the online process having flaws (using words like "strongly recommend you have...". or lacking details on what it is you are applying for. There is also the possibility of an auto payout if the amounts are not big.

  • Many thanks for your help, and apologies for the delay in response.

I can remember one card provider providing a pop up/paragraph about how would you pay your bill if you were unemployed or sick... I was recently single at the time so I took out the policy as I thought I would have no financial back up, but I really don't recall if that was Halifax or not...

Will Halifax provide me with screen grabs of how the application was worded back then (with their decision letter) or will I need to pursue this based on their response?

    Thank you for your help

unlikely they will do that. Normally they supply the data captured. They will have a generic template of the screen content on file though. Although they are not required to show you that (they would show the FOS if you ended up there).

  • Ok, well I'm going to give it a try. Nothing ventured as they say.

    Thanks again for your time.
