Natwest - Default due to package account.

Good evening everyone,

I'm hoping somebody will be able to help me.

Back in 2009, I went into my Natwest branch to deposit a cheque. At this point, the cashier told me that I had the wrong account and I should actually be using the Natwest Gold Advantage Account(?) as I was paying in x amount of money per month. I said that I was more than happy with the account I was using but was told it was the wrong account, and I shouldn't be using this.

Reluctantly, I sat down with the lady where she said she would upgrade my account to the correct account. I was told that all my direct debits/standing orders/salary would from now be paid into the correct account.

I was then told that I would receive certain information in the post regarding the new account - something which never arrived.

I continued to use my account under the impression that everything was sorted and I was now using "the correct account".

I moved into a new house in late '09 and possibly didn't change my address with the bank, so if any of the information was sent, it was possible it was my fault, as I didn't update my address. I checked my credit file a year or more later, and found there was a default on my account for Natwest (which was strange as I was using Natwest).

I called Natwest and was told that I had 2 accounts with them, 1 was a basic account, and 1 was an advantage gold account (which came with a monthly fee). As no money was ever paid into the account, the monthly fee was repeatedly taken at the end of the month, and as there was no money in the account to cover this, it had build up interest. I explained that I had no idea about this account, and only that I had upgraded my normal account as I was told and that all arrangements re direct debits etc would be made on their side. Apparently, this wasn't their fault.

As such, I stopped using Natwest, and switched to another bank.

I know that I can't reclaim anything as I never actually paid, but can I apply to have the default removed from my credit file? As I believe: it was missold in the first place; I never actually deposited any money into the account; there was no benefit to having the account and I didn't actually have to have it.

I have probably waffled an awful lot and I apologise but would appreciate any opinions?

    I sincerely doubt it.

    So far what you have said is classic misselling, ie you have the wrong account(how do they know?)

    Or you changed your address and the bank failed to follow your instruction although if you are being vague on this issue then you have assumed that you did not do that.

    So your complaint at this point is twofold. One is that the account was opened without your consent, two is that the account was missold and three is that you appear to have been told inaccurate information.
    As such, I stopped using Natwest, and switched to another bank.

    Because you stopped making contact with the bank then that is a problem especially after you found out about the default. I do think that you can go back to the bank and state that the account was missold and for the reasons given above. I'm not sure on default removal but if there is a default then surely there is money owing? That figure can be significantly reduced and from the details you've given I suspect that that issue can be resolved in your favour.

    Do you have any evidence about this meeting?
    If all your direct debits were to go out of this account, did you never think to check your original account or wonder why you never used any debit cards related to this account? Did you receive any?

  • I don't have any evidence about this meeting as I wasn't given anything - although I'm sure it's recorded on a system somewhere.

    Probably rather naively, I thought it was going to be the same account and they had to make a few tweaks on their side? I didnt receive another debit card or anything else for the account which added to this belief.

    Thanks for this. Yes there is money owing. I believe it's circa £1000. From what I can tell it's due to the first monthly account payment not going through as there were no funds in the account for obvious reasons.

    I'm a little sceptical about contacting them again if I don't have a leg to stand on as the default is now 5 years old, I was under the impression that it would then be revived so to speak and id be then stuck with the default for a further 6 years.

    Strangely - I haven't ever received a debt collector letter or anything for this. It was only upon checking my credit file I was made aware of it.

    Post on the debt free board, they may be able to help more.
    Give exact dates of the account opening and any correspondence regarding it.
