Laptop faulty (yet again) where do I stand ? (Comet)

Hi all,
I don't know where I could put this so I guessed here because it's a laptop...
I bought a laptop from Comet on 09/01/07 and all went ok for the first while... until 11/02/07 when I received an electric shock (!) from the laptop..
the next day I called Comet (Not the local store I think it may have been head office ?) and the woman (did'nt get her name
) was very helpful and said that if I just wanted to hand it into the local store they would have it repaired and ready to pick up.... So off I went to Comet thinking it would be straight forward.
I walked upto the counter and said that the system was faulty as it gave me an electric shock and the store assistant said "There's nothing we can do... you have to contact ACER direct.. I said about the sale of goods act stating that my contract was with Comet (the dealer) and not ACER (their dealer) but this did'nt help I asked him if there was therefore no aftersales service from Comet and he told me no. :S
So off I went to Trading standards ad to mae a ong story short they just dealt with it through ACER as they said it would just mae it easier for me rather than fighting with Comet (what ?!)
Since then I have felt as if I have been done... yes I have/had a working laptop but Comet had my money and they did'nt do anything for it.
However the laptop is broken again and I am seriously angry... and wathing programmes like 'Don't get done get Dom' and looking up the internet I want to go straight to Comet and have this sorted out to my satisfaction.
The current fault is that when you close the lid and it goes on 'Stand By you cant get it to come back on at all so when leaving the PC on I have to keep he lid open at all times (of if I close it I then have to reset it).
Where do I stand ?
I am going to write Down al details of this and comtact Comet... should I call first or write... should I go to head offce ? (i assume yes ?)
Would I be wrong to push for a refund ?
and could and one direct me to a copy of the sale of goods act ?
Any help would be much appreciated and I hope you can read this rant :rolleyes:

p.s. I really think people should go all the way with companies, not let them walk over their customers..... it's been going on too long in too may places.

try deleting your hiberfil.sys file, or turning off power saving in control panel, it's unlikely to be a hardware fault, and happens on loads of machines.Ever get the feeling you are wasting your time? :rolleyes:0

Also it is quite likely to be covered by at least one year manufacturer's warranty in which case, it IS ACER that you go through for that rather than Comet. If I had the choice of dealing with the retailer under the SOGA or manufacturer's warranty, I'd go with warranty every time. It is much more clean cut, manufacturer's tend to be easier to deal with and they are more capable in terms of repair or replacement. Go back to Comet and say you hve lost confidence in the product as you have had two problems with it in less then 6 months and get your money back.. You have the legal right to do this...

that's what I thought the problem was at first too but I disabled the hibernation mode completely when I first experienced this problem and it still has this problem :S I really don't know what it could be :S
Superscraper - thanks for your reply, with respect I understand how going to acer would be the easy method etc I just don't feel any justice in the fact that the contract is with Comet as they sold it to me.... I don't see why they should make a commision off of this pathetic excuse for service...
thebroker1980 - Am I 100% entitled to do this ? how would I approach this ?

It must be doing some type of standby, suspend or hibernation to do this when you shut the lid, they are either set in the bios settings, or in control panel. Power saving is always a bit ropey, so I usually turn it off completely, rather than risk a blue screen from not shutting it down properly.
If you send it back to Acer, the first thing they will want to do is to restore to factory settings.Ever get the feeling you are wasting your time? :rolleyes:0 -
You can set the laptop to do what you want when you close the lid, i have mine set to do nothing. I has kind of same problem with pc world. All i done is ask the manager to confirm in writing they had refused to accept it off me for repair, and walked out the shop and left it there. Next day gotta phone call asking me if i would like a new laptop that day or to get it repaired.0
