  • If you go to court and don't get the full amount, the credit hire company absorb the shortfall (unless you have misbehaved, which it sounds like you have not)

    The reason why bank statements and financial info will be needed from you is that the credit hire rates charged are far in excess of what it costs to hire on the high st with a direct hire company.

    The courts have established case law which means the claimant (you) has to establish you do not have the means to hire yourself without experiencing exceptional hardship.

    So the hire co or solicitors need your bank statements so that they can either prove you are "impecunious" (of limited means) so that the full daily credit hire rate can be recovered or, if your bank and credit card statements show you could have covered the cost of hiring out your own pocket, this will mean the credit hire co can only get the lowest local rate of hire for the same class of vehicle.
