Clearance items not actually 'clearance'

Hi All,

Hoping for a little bit of advice, I recently went to purchase an item from an Asda supermarket closest to my home, and they had sold out of the item i wanted, when i asked them to confirm if they were having any more in stock, they told me that they werent, and that it was a clearance item, hence the reduction by 50% in price.

I then called 2 other stores in the same town, and another 3 within a 50 mile radius of my home, but again, none had any stock left as they had reduced to half price because it was a clearance item.

I then found out that a store near to where i live (but hadnt called) had 15 in stock. Went to purchase one on the weekend, (13 in stock) but these were at full price, when i challenged the store manager about the reduction in 6 other stores, as they were 'clearance' items, he told me that he (that store) was not planning on reducing them and that they will stay at full price and will continue to order more in the future.

Are they able to do this, i thought that under the unfair trading act they were only allow to advertise a 'clearance' item if they were no longer stocking it anywhere. the two stores are just 7.9 miles away from each other!!

Can anyone give me some advice, the item in question had been reduced from £299 to £149 in the 'out of stock' stores, full price in the one with 13 in stock.

    You misunderstand the law. There is nothing to stop individual stores marking down goods as long as they have been for sale at the higher price before (and they did have stock to sell at the lower price), even if that higher price was at a different store. It sounds like this item will only be available at certain stores in the future, those that continue to stock the item are free to sell it at a higher price.

    Asda have different grades of store, this depends on square fottage of the store and what the store has in it, for example large clothes dept, furniture dept, etc. Some have very large electrical depts., some only a small area.

    It could be that this store is one of the larger ones and that they have the facility to sell more lines. It may also be that they have sold well there compared to other stores, so it is listed permanently for them.

    The store manager also has the facility to reduce prices on products he wants to clear, via the 'Managers reduction' labels they use.

    It could purely be the above case, not them being funny. What was the product if you don't mind being asked, there are Asda staff who post on here, who may be able to help you.

    The Unfair Trading Regulations are there, partly, to ensure that consumers aren't led into making a purchase that they would perhaps otherwise not make.

    So if Asda told you that this was a clearance item available for one day only, and then it remained at that price, then that might be a breach of the regulations. Or if they advertised this clearance item and then it transpired they deliberately didn't have any, and it was just part of a bait and switch trick, that might be a breach.

    The problem here is that I can't see Asda have done anything wrong. The store had the items on clearance because that is what they were genuinely doing. I know my local Tesco Extra does this as well, I assume it's because that branch doesn't want to stock the item any more and it's cheaper to sell it off cheaply rather than get it moved to another store.

    Well seeing the amount of times I've seen the "trading standards act" on here a lot of people obviously make up what they think is the law instead of knowing whether it really exists or not.
