    The contravention date was 10/02/2014 but the issue date of this notice was 17/03/2014, over a month later


    Sounds like a windscreen ticket case with the right deadline...? Did the postal letter refer to a PCN already served?

    According to the possible drivers, there was no ticket on the windscreen. The postal letter does refer to a parking charge notice already served...

    The alleged contravention was documented and recorded at the above car park on the 10/02/2014 and a Parking Charge Notice was either affixed to the vehicle or issued through the post and remains unpaid

    Nor did I receive anything through the post prior to the NTK

    Furthermore the contravention date on the newlyns letters is 24/02/2014, miss-communication between VCS and newlyns?

    Don't name the driver then - it was a windscreen ticket case so they have not missed the deadline (even though no ticket seen on the windscreen). Just collect the letters, you are at debt collector stage so ignore it unless you get court papers (highly unlikely).

    non-relevant land for POFA 2012 is land like docks , airports etc

    doesnt sound like this is one of those so treat it as private relevant land like private car parks

    nobody said it was easy to find out landowners details but one method is look for anyone else with similar problems , using search words like street names or retail park names (like peel centre or crown point on here in the search box)

    it should have the creditors name on the paperwork, but they may have omitted it to make things harder for you

    the last resort is pay the land registry

    like I said, tracking down land ownership isnt easy

    plus follow what coupon-mad told you , to the letter ;)

    Okay thanks again guys.

    Coupon-mad, last night I did send an email to VCS refusing to deal with the debt collectors and making them aware that I am the registered owner but not the driver at the time. I also requested photographic evidence that my vehicle was in that car park, I should be able to see the ticket on the windscreen if they bothered to put one up.

    Surely they have to provide proof that a ticket was placed on my vehicle or recorded delivery of a notice delivered on time?

    I will continue to ignore the debt collector letters.

    Redx I will try to pinpoint the car park owner and then use the templates in the stickies.

    if this went to court, that is the time all the proof would be brought out (or in the pre-trial paperwork)

    they are chasing an invoice and can and will take all steps to get their pound of flesh and they do not have to prove anything to you at this stage

    if they issue an MCOL, that is when they have to prove their case, their locus , in order to win a judgement, its also the time you defend your corner

    if this is in england or wales and after 1st october 2012 then I fail to see why you are arguing over if you are the driver or the keeper, pofa 2012 makes the registered keeper responsible for the matters arising from the vehicle being parked somewhere (on relevant land) etc (ideally you never name the driver but they are chasing YOU as RK)

    If there was no windscreen PCN then naming the driver "resets the clock" and allows the driver to follow the appeals process.

    If there WAS a windscreen PCN (or alleged to have been one) then naming the driver simply switches focus from keeper to driver - the PPC is not obliged to accept any appeals from the driver.

    They can't. I have already told you that only applies to POSTAL PCNs. Relax and ignore it now. You've written to state your position which is fine. Now get on with life.
