Please Help I`m new to this.
Just recently I wrote to HSBC claiming for my ppi back using the MSE template. Formally it was the GM card which I have had since 1996 and now HSBC. I Received a letter on the 12th june to say that they are unable to uphold the complaint.
I wrote on the template letter that it was never explained to me that the PPI was optional and that it was miss sold.
Also I cannot remember if the application form in 1996 was already pre- ticked and I should have put a cross through it.
Any How HSBC say in the letter that the ppi purchased was a non- advised sale and upon personal review of their records, they can confirm that PPI was applied when I initially opened the account and it was requested by me on the application form.
However my concern is that the card was originally the GM card so how do they have these records.
Then in the next sentence of the letter, they say due to the Data protection Act ,HSBC cannot keep records to the the product in question which cannot be located at this time and may have been destroyed.
They then at the end of the letter basically said that 18 years have elapsed before any contact has been made to query this .
Which I thought was a bit sarcastic.
Well I am going to write to the Financial Ombudsman Service with the next template on MSE.
Does anyone have any good advise as to add to my letter to the Ombudsman to uphold my claim as I could do with some money back that I`ve paid all these years.
Thanks for reading.

You need to prove your assertion on the balance of probabilities. You can't remember what happened at the time and you have not queried it for eighteen years - what evidence do you have to prove your case?0

Hello Tomtontom,
Thank you for your reply.
How do I prove that the probability is in my favour ?
I believe that I didn`t sign for and request ppi. However its only after all this time that I`m aware I feel I have a case of being miss sold due to this site.
And the fact they have told me I applied for it and then they have no records to prove this as they said they are all destroyed.
I just want to write a good letter to the Ombudsman with good examples and details that reflects an upheld decision in my favour.0 -
You can only state the facts as you know them, good examples are irrelevant if they are about someone else. By all means appeal if you wish, but on the information given you have no case.0
