    Someone who is ill can claim ESA, that makes them "the claimant" the claim is in their name.

    They can then claim for their partner aswell, the partner does not have to be ill. So ESA will pay either a single person rate or a couple rate if you add your partner to your claim.

    Some people with a partner will not be able to get just the single person rate because they have not worked enough, these people will get national insurance credits only , they can try to claim includiing their partner but not everyonequalifies for that either because they might have savings or other income.

    Is this the same for income support? If someone were claiming I.S as a carer and having a young baby and moved their partner in who is on jsa could he be added to her I.S claim even though he doesn't meet the criteria for I.S as a single person?

    Yes, that could happen, but for the JSA to remain open it would have to be
    • JSA Conts or
    • JSA NI Credits only.
    If it is JSA IB (in payment) it would have to be converted to one of the the other 2.

    The advice given re hubby being included in OP's ESA(IR) assessment is based on the assumption that hubby has no other form of income and has not had a redundancy payout of more than £16k, if he has, the information provided is not necessarily correct.
