Hi all,
A newbie here...
I've just read the Newbie thread and noticed that "the Notice has to arrive by day 15 if there was no windscreen ticket".
To clarify, on my letter it states the vehicle was caught on camera by ANPR on 02/06/2014 and the 'Date of issue of this notice' was 17/06/2014.
I was away from 15/6/14 to 23/6/14 so can't be sure when it was delivered but I assume that the 'Date off issue of this notice' ie 17/6/14 was the day it was printed so guessing it would have turned up through my door a couple of days after that.
Is that important?
Should I note this in the 1st appeal letter template?

Also, I was going to include the following because... well, it's what I know to be the case...
"Note – The photos shown on the ‘notice’ received show a vehicle moving slowing in the correct direction for approximately 16 seconds. A vehicle moving slowing in the correct direction for approximately 16 seconds does not constitute a parked vehicle in any case. From the images provided it is clear that at no time was the vehicle stationary".

This APCOA Airport thread has a first appeal and POPLA appeal wording shown, all suited to your case in many ways. Or find the new first appeal template in the NEWBIES thread for appeal:

And yes, you can add two things to the template you decide to use, the one you said about moving traffic so not parked, and one that, due to Airport Bylaws prevailing, the POFA 2012 does not apply* so there is no keeper liability.
*as the POFA does not apply, nor does the deadline really matter either, it's just proof again that there's no keeper liability. If the PCN suggests the keeper is 'liable' if he driver is not named, then that's a lie. Report them to the BPA and DVLA if so, using the email addies in post #6 of the top sticky thread for newbies.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They have sent me a POLA form to complete and submit. I just wondered what I should put in the box "Tell us your reasons"
Do I simply put, I was not driving and I am not obliged to divulge who the driver was?

You do not have to use the form provided as long as you ensure that the details - particularly the POPLA reference - is used.
POPLA are not interested in who was driving and unless you have already disclosed who the driver is we recommend that you don't and word any appeal as though it was made by the keeper alone.
Winning at POPLA is not about the circumstances but about pressing the correct legal buttons. NO! That will get you absolutely nowhere! If you won't divulge who the driver was then (and no one is suggesting you should) they're, legitimately after you, the Registered Keeper, so good luck with that line. :cool:
Have you checked out the link that Coupon-mad gave you around a month ago? You really need to be getting your head around this stuff, which I don't think you have, given your quote above.
We can help you along the way, but from where you appear to be presently we won't be able to provide that level of support; we don't have the resources do this for you.

Of course not! It's not just a matter of writing a short sentence in a box on a form. I had already told you where to find the POPLA appeal to use/adapt and send, not sure why you missed the fact...make us wonder why we bother sometimes...you can lead a horse to water...PRIVATE 'PCN'?
